NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that at 6:30 PM on TUESDAY, FEBRUARY 2, 2016, the City of Beaverton City Council will conduct a public hearing on the application described below. The City Council will meet at the Beaverton Building located at 12725 SW Millikan Drive, Beaverton, Oregon, in the Council Chambers.
TA 2015-0005 RECREATIONAL MARIJUANA TEXT AMENDMENT This proposal is to amend the Beaverton Development Code Chapter 20 (Land Uses) to establish new regulations for recreational marijuana uses as authorized by Oregon Voters in Ballot Measure 91. The new regulations will address Marijuana Processing, Wholesale Marijuana Sales, and Retail Marijuana Sales. The zones in which marijuana processing and wholesale marijuana sales are proposed to be permitted uses are in the Office Industrial (OI) and the Industrial (IND) zoning districts. Retail marijuana sales are proposed to be allowed in the General Commercial (GC), Community Service (CS), and Corridor Commercial (CC) zoning districts. The proposed amendment will also add definitions of marijuana based uses to Chapter 90 (Definitions) of the Development Code. Other regulations include hours or operation and buffers from other marijuana uses and public recreational facilities. The amendment is being proposed consistent with State of Oregon draft regulations governing recreational marijuana uses. Approval criteria for the Text Amendment includes Section 40.85.15.1.C. Failure to raise an issue prior to or at the City Council hearing, in person or by letter, or failure to provide statements or evidence sufficient to afford the City Council an opportunity to respond to the issue precludes appeal to a court of competent jurisdiction on that issue.
