By virtue of a Writ of Execution dated December 14, 2015, for the sale of real property issued out of the above-entitled Court in the above-entitled cause, to me directed and pursuant to a General Judgment of Foreclosure entered in said Court on October 30, 2015, wherein it was decreed that a certain real estate deed of trust held by Plaintiff be foreclosed and that the real property subject to the lien of said real estate deed of trust be sold, which Writ of Execution commanded me to sell that real property to satisfy the indebtedness set forth in said decree, in favor of Plaintiff United States of America and against the real estate described in the deed of trust in the sum of $47,984.75 ($27,816.33 principal and $7,128.79 interest accrued through May 28, 2013, plus $11,866.62 subsidy subject to recapture and $13,039.64 in fees) and interest to accrue at the daily rate of $5.91 from May 28, 2013, to the date of judgment and interest thereafter at the annual rate (pursuant to 28 USC § 1961) of 0.23 Percent computed daily and compounded annually after judgment until paid, and $2,319.24 for Plaintiff’s costs and disbursements incurred herein, plus costs of sale.
I HEREBY CERTIFY that I have levied on all the right, title and interest of the above-named Defendants in and to the following-described real property situated in Jefferson County, Oregon, to-wit:
Lot One (1) and the North half (N1/2) of Lot Two (2), Block Seven (7), PALMAIN, recorded July 18, 1902, in Volume 1 of Plats, Page 10, Jefferson County, Oregon
NOW, THEREFORE, by virtue of said Writ of Execution and in compliance with the commands of said Execution, I will on Thursday, April 14, 2016, at 1:00 p.m. on the steps of the Jefferson County Courthouse, 75 S.E. “C” Street, Madras, Oregon, sell at public auction all of the right, title and interest of the Defendants in and to the real property described above, or any part thereof, to satisfy execution costs and indebtedness set forth above. Said real property will be sold to the highest bidder for cashier’s check or certified check payable to “Clerk, U.S. District Court” for ten percent (10%) at the time of the bid and the balance to be paid by the end of the business day on the day of the sale which will be deposited with the Clerk of the U.S. District Court. Said ten percent bid will be forfeited to the United States if the successful purchaser fails to pay the balance of the bid, by cashier’s check or certified check, at the end of the business day on the day of the sale. The purchaser is entitled to exclusive possession of the real property from and after the date of sale and is entitled to such remedies as are available at law to secure possession, including a writ of assistance, if defendant[s], or any of them or any other party or person shall refuse to surrender possession to the purchaser immediately on the purchaser’s demand for possession.
