NOTICE OF PUBLIC HEARINGS
NOTICE IS HEREBY GIVEN that the City of Cornelius City Planning Commission on Tuesday, August 23, 2016 at 7:00 PM will meet in the City of Cornelius Council Chambers, 1310 N. Adair, Cornelius, Oregon, to consider the following. If there is a recommendation for approval, the City of Cornelius City Council will consider the following on Tuesday, September 6, 2016 at 7:00 PM at the same location.
Request: A Type III Annexation, Comprehensive Plan Amendment, and Zoning Map Amendment (AN-02-16, CPA-02-16 & ZC-03-16) application to: Annexation of approximately 17.44 acres of land into the Cornelius City Limits; Comprehensive Plan Amendment for approximately 5.43 acres of land that is outside of the Urban Growth Boundary from Rural Reserve to Low-Density Residential; Amend the Zoning Map from County AF-20 zoning to City Single-Family Residential (R-7) zoning on approximately 10.03 acres of land, and County AF-20 zoning to City Single-Family Residential (R-7) with a Natural Resource Overlay (NRO) zone on approximately 7.41 acres of land. The 7.41 acres will be a protected Goal 5 Natural Resource area.

Applicable Review Criteria: Chapters 18.10 & 18.15 (Application & Review Procedures); Chapter 18.20 Single-Family Residential Zone (R-7); Chapter 18.95 Natural Resource Overlay (NRO); Chapter 18.125 Zone Map Amendment; Chapter 18.130 Comprehensive Plan. There are no specific criteria for deciding city boundary changes within Oregon State Statues. However, the State Legislature has directed Metro Regional Services (Metro) to establish criteria, which must be used by all cities within the Metro boundary; these criteria are found in Metro Code Chapter 3.09. The City Comprehensive Plan identifies annexation requirements in Chapter II, Urbanization, Policies.
At the time and place listed above all persons will be given a reasonable opportunity to give testimony either for or against the proposal. Testimony may be either in oral or written form and must be relevant to the criteria listed above on which the proposal will be evaluated. At the public hearings, the Planning Commission Chair and Mayor will open the public hearing, a staff report will be presented, interested persons will be allowed to speak for or against the proposal or to ask questions, Commissioners may ask for any general questions, and the public hearing will be closed. The Planning Commission will make a formal recommendation to City Council.
In order for an issue to be considered for appeal, it must be raised before the close of the record of the public hearing. Such issues must be raised with sufficient specificity so as to afford the hearing body and the parties an adequate opportunity to respond to each issue. If there is no continuance granted at the hearing, any participant in the hearing might request that the record remain open for at least seven days after the hearing.
A copy of the application, all documents and evidence relied upon by the applicant and applicable criteria are available for review at the Community Development Department, 1300 S. Kodiak Circle during regular business hours, prior to the scheduled public hearing. Copies may also be purchased at a reasonable cost of 25 cents per page.
