Notice is hereby given that the City of Happy Valley Planning Commission, City Council and Design Review Board will hold public hearings on the following dates in regard to the applications described herein:
Date & Time: Planning Commission-October 11, 2016 at 7:00 p.m.
City Council – November 1, 2016 at 7:00 p.m.
Design Review Board – November 30, 2016 at 7:00 p.m.

and DR-10-16 “CHRISTILLA COMMONS”: ZONE CHANGE, FOUR-LOT COMMERCIAL SUBDIVISION, ENVIRONMENTAL REVIEW PERMIT AND MAJOR DESIGN REVIEW.
Proposal: A Comprehensive Plan/Zoning Map Amendment to
change the subject site’s current plan designation/zoning district from Community Commercial Center (CCC) to Mixed Use Commercial (MUC), a four-lot commercial Subdivision, an Environmental Review Permit (for natural resources) and Major Design Review on two tax lots comprising 4.1 acres. The applicant’s proposal includes approval of three buildings (A-C) totaling 43,890 square feet of commercial/office space, 26 multifamily residential units, 304 parking spaces, and associated drive-aisles and landscaped areas. Building A is a 21,650 square-foot three-level building comprised of a main floor restaurant, second floor bar/restaurant, and lower level storage/office space. Building B is a 5,940 square-foot single-level commercial/office building. Building C is a four-level mixed-use commercial building comprised of 16,300 square feet of ground floor commercial space, a second story with 19 apartment units, a third story on the north half of the structure with an additional seven apartment units, and a lower level parking garage with 38 parking spaces for the residential tenants.

and approximately 400 feet north of Sunnyside Road.

Applicable Criteria: Applicable Statewide Planning Goals; applicable
Oregon Administrative Rules; applicable City of Happy Valley Comprehensive Plan Policies; and applicable sections of the City of Happy Valley Municipal Code; Title 16-Land Development Code: Chapters 16.23, 16.34, 16.41, 16.42, 16.43, 16.44, 16.46, 16.50, 16.61, 16.62 16.63 and 16.67.

Interested parties are invited to attend this hearing or to submit comments in writing prior to the meeting time. Written testimony may be submitted in advance or in person at the hearing. Those wishing to present verbal testimony, either pro, con, or to raise questions, will be asked to speak after presentation of the report.
Testimony should pertain to the applicable criteria. The recommendation of the Planning Commission, decision by the City Council and decision Design Review Board will be made in accordance with said criteria. Failure to raise an issue in writing prior to or before the close of the written comment period, Wednesday, September 28, 2016 by 5:00 p.m. or failure to provide sufficient specificity at the public hearing to afford the hearing body an opportunity to respond to the issue precludes appeal to the Land Use Board of Appeals based upon that issue. The applicant and any person who submits written comments shall receive notice of the decision. The failure of the applicant to raise constitutional or other issues relating to proposed conditions of approval with sufficient specificity to allow this Commission to respond to the issue precludes an action for damages in circuit court.
