TRUSTEE’S NOTICE OF SALE
Reference is made to that certain Trust Deed made by Tyler L. Dunn and Samara E. Young, not as tenants in common but with the rights of survivorship, as Grantor, to First American Title Insurance Company, as Trustee, in favor of Geraldine Bower, as Beneficiary, dated April 28, 2014, recorded on April 29, 2014, in the Records of Yamhill County, Oregon, as instrument no. 201404786, covering the following described Real Property, commonly known as 20840 Baker Creek Rd, McMinnville, OR 97128, situated in the aforsaid county and state:
A tract of land located in Section 8, Township 4 South, Range 5 West of the Willamette Meridian in Yamhill County, Oregon, being more particularly described as follows:

D. Eugene Pierson was appointed as Trustee by an appointment of successor trustee recorded pursuant to ORS 86.752(1).
Both the Beneficiary and the Trustee have elected to sell the Real Property to satisfy the obligations secured by the Trust Deed and a notice of default has been recorded pursuant to ORS 86.752(3). The default for which foreclosure is made is Grantor’s failure to pay when due the following sums:
Monthly principal and interest payments of $1,689.71 each beginning June 1, 2016, until paid; plus monthly escrow installments of $8.00 each beginning June 1, 2016, until paid; monthly make up payments of $844.86 each beginning September 1, 2016, until and including February 1, 2017, accrued late charges in the amount of $675.92 as of September 16, 2016, plus monthly late charges of $84.49 each beginning October 16, 2016, until paid; delinquent property taxes, if any; cost of foreclosure report; attorney’s fees; together with any other sums due or that may become due under the Note or by reason of this foreclosure and any further advances made by Beneficiary as allowed by the Note and Trust Deed.
By reason of the default, the Beneficiary has declared all sums owing on the obligation secured by the Trust Deed immediately due and payable, those sums being the following:
The principal sum of $209,369.34 with interest on the principal balance at the rate of 9% per annum, from March 9, 2016, until paid; accrued late charges in the amount of $675.92 as of September 16, 2016, plus monthly late charges of $84.49 each beginning October 16, 2016, until paid; cost of foreclosure report; attorney’s fees, Trustee’s fees, together with any other sums due or that may become due under the Note or by reason of this foreclosure and any further advances made by Beneficiary as allowed by the Note and Trust Deed.
WHEREFORE, NOTICE IS HEREBY GIVEN that the undersigned Trustee, will on February 28, 2017, at the hour of 2:30 PM, in accord with the standard of time established by ORS 187.110, at the following place: Front entrance of the Yamhill County Courthouse, 535 NE 5th St, McMinnville, Yamhill County, Oregon, sell at public auction to the highest bidder for cash the interest in the Real Property which Grantor had, or had the power to convey, at the time of the execution by Grantor of the Trust Deed, together with any interest Grantor or Grantor’s successor in interest acquired after the execution of the Trust Deed to satisfy the obligations secured by the Trust Deed and expenses of the sale, including compensation of the Trustee and a reasonable charge by the attorney.
NOTICE IS FURTHER GIVEN that any person named in ORS 86.778 has the right to have this foreclosure proceeding dismissed and the Trust Deed reinstated by payment to the Beneficiary of the entire amount then due (other than such portion of the principal as would not then be due had no default occurred), together with costs, Trustee’s fees and attorney fees, and by curing any other default complained of in the notice of default, at any time that is not later than five days before the date last set for the sale.
Without limiting the Trustee’s disclaimer of representations or warranties, Oregon law requires the Trustee to state in this notice that some residential property sold at a trustee’s sale may have been used in manufacturing methamphetamines, the chemical components of which are known to be toxic. Prospective purchasers of residential property should be aware of this potential danger before deciding to place a bid for this property at the trustee’s sale.
Attached hereto and made a part hereof is the Notice to Residential Tenants.
In construing this notice, the singular includes the plural, the word “Grantor” includes any successor in interest to the Grantor as well as any other person owing an obligation, the performance of which is secured by the Trust Deed, and the words “Trustee” and “Beneficiary” include their respective successors in interest, if any.
