The site is zoned Residential – Twenty Thousand (20,000) Square Feet (R-20), Residential – Seven Thousand (7,000) Square Feet (R-7), Residential – Five Thousand (5,000) Square Feet (R-5) and Single-Family Attached Residential (SFA). The Environmental Review Permits are required due to the presence of steep slopes and natural resources and the Variance is to the maximum number of lots allowed on a private street. The failure of the applicant to raise constitutional or other issues relating to proposed conditions of approval without sufficient specificity to allow the decision-making body to respond to the issue precludes an action for damages in circuit court.
