TRUSTEE’S NOTICE OF SALE A default has occurred under the terms of a Trust Deed made by Folsom Farms, LLC, an Oregon limited liability company, Grantor, First American Title Company of Oregon, the original Trustee, and AMR Investment Group, LLC, Beneficiary, under that certain Trust Deed dated July 11, 2017 and recorded in the records of Clackamas County, Oregon on July 17, 2017 as Document No. 2017-048562. The above-described Trust Deed concerns the following described real property: The land referred to herein below is situated in the County of Clackamas, State of OR, and is described as follows: A tract of land in Sections 5, 6, 7 and 8, Township 3 South, Range 4 East, of the Willamette Meridian, in the County of Clackamas and State of Oregon, being a portion of the John B. Chile’s Donation Land Claim No. 44, described as follows: Beginning at the Southwest corner of said claim; thence North 19deg.30′ West along the West line of the claim, 35.59 chains; thence East 13.00 chains to the Southwesterly corner of that tract of land conveyed to Lloyd A. Epperson, et ux, recorded April 30, 1946, in Book 366, Page 189, Deed Records and the true point of beginning of that tract of land herein to be described; thence East along the South line of the Epperson tract 1200.00 feet, more or less, to the Westerly line of that tract of land disclosed in document to the Oregon Water Power and Railway Company, recorded September 6, 1902 in Book 83, Page 433, Deed Records; thence Northwesterly along the Westerly line of the Oregon Water Power and Railway Company tract, 1000.00 feet, more or less, to the South line of Parcel 2 of the tract of land conveyed to the State of Oregon, by and through its State Highway Commission, recorded February 5, 1971 as Recorder’s Fee No, 71-2331, Film Records; thence Northwesterly along the Southerly and Westerly boundary of said Parcel 2, a distance of 600.00 feet, more or less, to the Southerly line of Folson Road, County Road No. 525; thence Westerly along the road line, 1150.00 feet, more or less, to the Westerly line of the Epperson tract; thence South 15deg.30′ East along the Westerly line of the Epperson tract, 1525.00 feet, more or less, to the true point of beginning. Common address: 30410 SE Folsom Road, Eagle Creek, OR 97022. Both the Beneficiary and the Trustee have elected to sell the said real property to satisfy the obligations secured by said Trust Deed and an Amended Notice of Default and Election to Sell has been recorded pursuant to Oregon Revised Statutes 86.735(3); the default for which the foreclosure is made is Grantor’s failure to pay the entire balance due as of July 31, 2019; plus unpaid real property taxes for tax year 2018-2019 in the amount of $3,818.15, plus interest. By reason of the default, the Beneficiary has declared all sums owing on the obligation secured by the Trust Deed immediately due and payable, those sums being the principal amount of $422,500.00 plus accrued interest as of September 15, 2019 in the amount of $6,319.90; plus interest on the principal amount at the rate of 17.95% per annum from September 16, 2019 until paid; plus late fees; plus amounts, if any, advanced by the Beneficiary pursuant to the Trust Deed and/or applicable law; plus foreclosure costs and attorney fees incurred herein. Notice hereby is given that the Beneficiary and Trustee, by reason of the default, have elected and do hereby elect to foreclose the Trust Deed by advertisement and sale pursuant to ORS 86.705 to 86.795, and to cause to be sold at public auction to the highest bidder for cash the interest in the described property which the Grantor had, or had the power to convey, at the time of the execution by Grantor of the Trust Deed, together with any interest the Grantor or Grantor’s successor in interest acquired after the execution of the Trust Deed, to satisfy the obligations secured by the Trust Deed and the expenses of the sale, including the compensations of the Trustee as provided by law, and the reasonable fees of Trustee’s attorneys. The sale will be held at the hour of 10:00 a.m. in accordance with the standard of time established by ORS 187.110 on February 20, 2020 inside the main entrance of the Clackamas County Courthouse located at 807 Main Street, Oregon City, Oregon, which is the hour, date and place set for sale. Notice is further given that any person named in ORS 86.753 has the right, at any time prior to five days before the date last set for the sale, to have this foreclosure proceeding dismissed and the Trust Deed reinstated by payment to the Beneficiary of the entire amount then due, other than such portion of the principal as would not then be due had no default occurred; curing any other default that is capable of being cured, by tendering the performance required under the obligation or Trust Deed; and paying all costs and expenses actually incurred in enforcing the obligation and Trust Deed, together with the Trustee’s and attorney fees not exceeding the amount provided in ORS 86.753. In construing this notice, the singular includes the plural, the word grantor includes any successor in interest to the grantor as well as any other person owing an obligation, the performance of which is secured by the Trust Deed, and the words trustee and beneficiary include their respective successors in interest, if any. NOTICE REGARDING POTENTIAL HAZARDS (this notice is required for notices of sale sent on or after January 1, 2015): Without limiting the Trustee’s disclaimer of representations or warranties, Oregon law requires the Trustee to state in this notice that some residential property sold at a Trustee’s sale may have been used in manufacturing methamphetamines, the chemical components of which are known to be toxic. Prospective purchasers of residential property should be aware of this potential danger before deciding to place a bid for this property at the trustee’s sale.
