Proposal: A Comprehensive Plan/Zoning Map Amendment, Design Review Amendment and Environmental Review Permit application on a site totaling 7.32 acres. The site is currently zoned Rural Residential Farm Forest 5-Acre (RRFF-5) and Mixed Use Residential – Multifamily (MUR-M2). The applicant has submitted a Comprehensive Plan/Zoning Map Amendment to change the existing zoning to Mixed Commercial Center (MCC) to match the Happy Valley Crossroads East site. The Comprehensive Plan/Zoning Map Amendment, the Design Review Amendment and Environmental Review Permit will facilitate the construction of a memory care facility expansion to the previously approved independent living/assisted living facility (The Springs Living). The proposed memory care facility will be a 25,675 square-foot expansion with 32 units. It will also include an additional 17 vehicular parking stalls and associated landscaping and hardscaping. The previously approved independent living/assisted living facility was 226,288 square feet. Location: The subject site is located at 13100 SE 172nd Avenue (northeast corner of 172nd Avenue and Sunnyside Road). Failure to raise an issue in writing prior to the close of the written comment period, Tuesday, May 26, 2020 by 5:00 p.m. or failure to provide sufficient specificity at the virtual public hearing to afford the decision-making body an opportunity to respond to the issue precludes appeal to the Land Use Board of Appeals based upon that issue. The applicant and any person who submits written comments shall receive notice of the decision. The failure of the applicant to raise constitutional or other issues relating to proposed conditions of approval without sufficient specificity to allow the decision-making body to respond to the issue precludes an action for damages in circuit court.
