NOTICE OF PUBLIC HEARING Zoning code text amendments file TXT-2020-02. On Tuesday, July 21, 2020, beginning no earlier than 6:30 p.m. in the Council Chambers of Gladstone City Hall, 525 Portland Ave., Gladstone, Oregon, the Gladstone Planning Commission will hold a public hearing to consider amendments pertaining to: 1) the parking requirements for the substitution of institutional or civic land uses in the C-2 Zoning District; and 2) the addition of definitions for vacation rental and vacation occupancy in Chapter 17.06. Clackamas County is in the initial stages of designing a new library for the city, planned for the site of the old Gladstone City Hall. The property is zoned C-2 and is subject to Section 17.18 of the Gladstone municipal Code. An existing provision in the city’s code, 17.18.070(1), generally allows new commercial uses in the C-2 zone to be substituted for old uses without providing any additional off-street parking. Because both the prior use and future use of the site are better described as institutional or civic rather than commercial, it is not clear whether the county could rely on 17.18.070(1) to build the library without any off-street parking. Therefore, the Planning Commission will consider a text amendment that would allow institutional or civic uses to be substituted in the C-2 zone without providing any additional off-street parking. House Bill 2001 prohibits local governments from requiring additional off-street parking and owner-occupancy requirements for Accessory Dwelling Units (ADUs). The law provides an exception for ADUs that are used for vacation rentals. Previous amendments updated the city code to remove these requirements unless the ADU is used as a vacation rental. The Gladstone Municipal Code now needs a definition of vacation rental and vacation occupancy. These proposals are subject to Chapter 17.68, Amendments and Zone Changes and Chapter 17.94, Hearings, of Title 17 of the Gladstone Municipal Code and are available for inspection at Gladstone City Hall and at the Clackamas County Building Services Building, 150 Beavercreek Road, Oregon City, Oregon, Monday through Friday from 8:00 a.m. to 5:00 p.m. Due to COVID-19, the hours open to the public may be reduced. A copy of the proposal is available for a reasonable cost.
