RESOLUTION NO. 2160 A RESOLUTION ADDRESSING FAIR HOUSING ASSISTANCE IN THE CITY OF WOODBURN, AS REQUIRED BY THE OREGON COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM AND THE UNITED STATEMENT DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT; AND REPEALING AND REPLACING RESOLUTION NO. 1346 WHEREAS, discrimination in the sale, rental, lease, advertising of sale, rental or lease, financing of housing or land to be used for construction of housing, or in the provision of brokerage or rental services because of race, color, religion, sex, disability (physical or mental), familial status (children) or national origin is prohibited by Title VIII of the federal Fair Housing Amendments Act of 1988; WHEREAS, It is the policy of the City of Woodburn to support the Fair Housing Amendments Act of 1988 and to implement a Fair Housing Program to ensure equal opportunity in housing for all persons regardless of race, color, religion, sex, disability (physical and mental), familial status (1. children, and 2. actual or perceived sexual orientation, gender identity or marital status or its members), or national origin; WHEREAS, The City of Woodburn is the recipient of a Community Development Block Grant for the FY 2019-2020; WHEREAS, the Oregon Community Development Program and the United States Department of Housing and Urban Development require that this resolution be adopted to replace the City’s previously adopted Fair Housing Resolution (No. 1346); NOW, THEREFORE, THE CITY OF WOODBURN RESOLVES AS FOLLOWS: Section 1. That within the resources available to the City through city, county, state, federal and community volunteer sources, the City of Woodburn will assist all persons who feel they have been discriminated against because of race, color, religion, sex, disability (physical and mental), familial status (children) or national origin in the process of filing a complaint with the Oregon Civil Rights Division or the U.S. Department of Housing and Urban Development, Seattle Regional Office Compliance Division, that they may seek equity under federal and state laws. Section 2. That the City shall publicize this Resolution and through this publicity shall cause real estate brokers and sellers, private home sellers, rental owners, rental property managers, real estate and rental advertisers, lenders, builders, developers, home buyers and home or apartment renters to become aware of their respective responsibilities and rights under the Fair Housing Amendments Act of 1988 and any applicable state or local laws or ordinances. Section 3. THE FAIR HOUSING PROGRAM, for the purpose of informing those affected of their respective responsibilities and rights concerning Fair Housing law and complaint procedures, will at a minimum include, but not be limited to: 1) the printing, publicizing and distribution of this Resolution; 2) the distribution of posters, flyers, pamphlets and other applicable Fair Housing information provided by local, state and federal sources, through local media of community contacts; and 3) the publicizing of locations where assistance will be provided to those seeking to file a discrimination complaint. Section 4. The City’s previously adopted Fair Housing Resolution (No. 1346) is hereby repealed and replaced upon adoption of this Resolution. Passed by the Woodburn City Council August 10, 2020 and approved by the Mayor August 12, 2020 Published August 26, 2020.WI175100 RESOLUCIN NO. 2160 UNA RESOLUCIN DIRIGIDA A LA ASISTENCIA DE VIVIENDA JUSTA EN LA CIUDAD DE WOODBURN, SEGN LO REQUIEREN EL PROGRAMA DE SUBVENCIONES EN BLOQUES DE DESARROLLO COMUNITARIO DE OREGON Y LA DECLARACIN UNIDA DEL DEPARTAMENTO DE VIVIENDA Y DESARROLLO URBANO; Y REVOCAR Y REEMPLAZAR LA RESOLUCIN NO. 1346 CONSIDERANDO, que la discriminacin en la venta, alquiler, arrendamiento, publicidad de venta, alquiler o arrendamiento, financiamiento de la vivienda o terrenos que se utilizarn para la construccin de viviendas, o en la prestacin de servicios de corretaje o alquiler por motivos de raza, color, religin, sexo , discapacidad (fsica o mental), estado familiar (nios) u origen nacional est prohibido por el Ttulo VIII de la Ley de Enmiendas de Vivienda Justa de 1988; CONSIDERANDO, que es poltica de la Ciudad de Woodburn apoyar la Ley de Enmiendas de Vivienda Justa de 1988 e implementar un Programa de Vivienda Justa para garantizar la igualdad de oportunidades en la vivienda para todas las personas independientemente de su raza, color, religin, sexo, discapacidad (fsica y mental), estado familiar (1. hijos y 2. orientacin sexual, identidad de genero o estado civil real o percibido o sus miembros), u origen nacional; CONSIDERANDO, que la Ciudad de Woodburn ha recibido una subvencin global de desarrollo comunitario para el ao fiscal 2019-2020; CONSIDERANDO, que el Programa de Desarrollo Comunitario de Oregn y el Departamento de Vivienda y Desarrollo Urbano de los Estados Unidos requieren que se adopte esta resolucin para reemplazar la Resolucin de Vivienda Justa adoptada previamente por la Ciudad (No. 1346); AHORA, POR LO TANTO, LA CIUDAD DE WOODBURN RESUELVE LO SIGUIENTE: Seccin 1. Que, dentro de los recursos disponibles para la Ciudad a traves de fuentes voluntarias de la ciudad, el condado, el estado, el gobierno federal y la comunidad, la Ciudad de Woodburn ayudar a todas las personas que sientan que han sido discriminadas por motivos de raza, color, religin, sexo o discapacidad. (fsica y mental), estado familiar (nios) u origen nacional en el proceso de presentacin de una queja ante la Divisin de Derechos Civiles de Oregn o el Departamento de Vivienda y Desarrollo Urbano de EE. UU., Divisin de Cumplimiento de la Oficina Regional de Seattle, para que puedan buscar equidad bajo y leyes estatales. Seccin 2. Que la Ciudad har pblica esta Resolucin y a traves de esta publicidad har que los agentes de bienes races y vendedores, los vendedores de casas privadas, los propietarios de alquileres, los administradores de propiedades de alquiler, los anunciantes de bienes races y de alquiler, las entidades crediticias, los constructores, los promotores inmobiliarios, los compradores de viviendas e inquilinos de apartamentos para conocer sus respectivas responsabilidades y derechos bajo la Ley de Enmiendas de Vivienda Justa de 1988 y cualquier ley u ordenanza estatal o local aplicable. Seccin 3. EL PROGRAMA DE VIVIENDA JUSTA, con el propsito de informar a los afectados de sus respectivas responsabilidades y derechos con respecto a la ley de Vivienda Justa y los procedimientos de quejas, incluir como mnimo, pero no se limitar a: 1) la impresin, publicidad y distribucin de esta Resolucin; 2) la distribucin de carteles, volantes, folletos y otra informacin de Vivienda Justa aplicable proporcionada por fuentes locales, estatales y federales, a traves de los medios locales de contactos comunitarios; y 3) la publicidad de los lugares donde se brindar asistencia a quienes deseen presentar una queja por discriminacin. Seccin 4. La Resolucin de Vivienda Justa adoptada previamente por la Ciudad (No. 1346) por la presente se deroga y reemplaza al adoptar esta Resolucin. Aprobado por el Concejo Municipal de Woodburn el 10 de agosto de 2020 y aprobado por el Alcalde el 12 de agosto de 2020.
