CITY OF HILLSBORO NOTICE OF PUBLIC HEARING CASE FILE NO. HCP-002-20: FASSOLD & CMK PROPERTIES NOTICE IS HEREBY GIVEN that a public hearing will be held before the Planning Commission through a Zoom virtual meeting at or shortly after 6:00 p.m., on Wednesday, August 25, 2021. Instructions on how to join the Zoom meeting are listed below. The Planning Commission will consider a city-initiated request for a Comprehensive Plan Amendment (HCP) on four properties totaling approximately 2.89 acres in size to accommodate future industrial development. The properties are currently developed with three single-family detached dwellings and accessory buildings. The proposed HCP Amendment would accomplish the following: — Change the Comprehensive Plan designation on Tax Lots 5500 and 5600 from a split designation of RM Residential Medium Density and IN Industrial to IN Industrial; and — Change the Comprehensive Plan designation on Tax Lots 5900 and 6000 from RM Residential Medium Density to IN Industrial. Concurrent with this application is a City initiated Zone Change to apply the City’s I-G Industrial General zone to all four properties, which is contingent upon the HCP approval. The Zone Change will be noticed separately and will be heard later by the City Council. The Planning Commission initiated both the HCP and Zone Change at their regular meeting on July 28, 2021. The subject properties can be specifically identified as Tax Lots 5500, 5600, 5900 and 6000 on Washington County Assessor’s Tax Map 1S2-09AD, and are generally located north of SE Alexander Street, south of SE Tualatin Valley Highway, and east of SE Brookwood Avenue/SE Witch Hazel Rd. The property owner of Tax Lot 5500, 5600 and 5900 is Larry Fassold, and the property owners of Tax Lot 6000 is CMK Properties, LLC. The applicant is the City of Hillsboro who initiated this application on the property owner’s behalf. The applicable criteria for this HCP may be found in Section 12.80.162 of the Community Development Code (CDC), and in Section 12.80.168 of the CDC for the Zone Change. The CDC may be viewed online at https://www.hillsboro-oregon.gov/departments/planning/codes-standards or in the Planning Department office. The complete application, staff report and responses to all related criteria for the HCP application will be available at https://hillsboro-oregon.civicweb.net/Portal/ by 4:00 p.m. on Wednesday, August 18, 2021. All interested persons are invited to attend this virtual hearing on Zoom (instructions below) and will be given an opportunity to be heard concerning the proposal. Testimony can be provided during the hearing via teleconference or submitted in writing prior to the meeting. Social Distancing is essential in reducing the spread of the COVID-19 Pandemic. Written Testimony: If you would like to submit written testimony ahead of the public hearing please send your testimony via email to planning_dept@hillsboro-oregon.gov. Testimony received prior to 8:00 am on the day of the public hearing will be posted to the agenda packet online. Testimony received after 8:00 am on the day of the public hearing will be forwarded to the City Council either before or during the meeting. Please note that City Council may have limited time to review any written testimony received after 8:00 am on the day of the public hearing. Please reference the case file no. on all written testimony. Teleconference Testimony: You may pre-register to speak during the public hearing by providing your name, phone number, address, and Zoom name to via email at planning_dept@hillsboro-oregon.gov prior to 5:00 pm on the day of the public hearing. Your information will not be shared at the meeting. If you pre-register and provide your information, the City will be able to mail you a copy of the notice of decision once the public hearing is closed and a decision has been rendered. At the public hearing, the Planning Commission President may read down the list of those who pre-registered. If you were unable to pre-register prior to the meeting, you may email plan during the meeting to request to speak. You will have three minutes to speak once called upon. Members of the public using Zoom will not be able to share their screen during the meeting; presentation materials should be submitted as written testimony by 5:00 pm on the day of the public hearing. Testimony should avoid repetition of issues, and should be based on the application or on the approval criteria listed above. ORS 197.763 provides that under certain circumstances, the record may remain open or a continuance may be granted upon the request of a participant. Telephone conversations cannot be accepted as testimony. General comments, requests and inquiries, not related to the public hearing, can be emailed to planning_dept@hillsboro-oregon.gov Pursuant to ORS 197.763, failure to raise an issue at the final evidentiary hearing, or by close of the record, in person or by letter, or failure to provide statements or evidence sufficient to afford the decision maker an opportunity to respond to the issue precludes appeal to the Land Use Board of Appeals based on that issue.
