NOTICE OF PUBLIC HEARING Pursuant to Chapter 1 of the Beaverton Comprehensive Plan and Chapter 50 of the Beaverton Development Code, public notice of the following applications is being provided: Peterkort Comprehensive Plan and Zoning Map Amendments (CPA2021-0004 and ZMA2021-0003) DATE, TIME, AND LOCATION OF HEARING: The Beaverton Planning Commission will hold a public hearing on these applications on October 27, 2021 at 6:30 p.m. The meeting will be held remotely, and can be viewed online at https://www.beavertonoregon.gov/291/Agendas-Minutes STAFF CONTACT: Lina Smith, Associate Planner, 503-526-2652, lsmith@ beavertonoregon.gov PROJECT LOCATION: Generally between SW Barnes Road and SW Taylor Street and east of SW Valeria View Drive, with the property wrapping around residential uses that front on SW Windwood Way. The property is specifically identified as Tax Lot 700 on Washington County Tax Assessor’s Map 1S102B. SUMMARY OF APPLICATION: The City of Beaverton proposes to amend the City Comprehensive Plan Land Use Map and Zoning Map to apply City land use and zoning designations to a parcel that is currently annexing into the City of Beaverton (Tax Lot 700 on Washington County Tax Assessor’s Map 1S102B) and the SW Taylor Street right of way abutting the northwest portion of the property. The subject property contains the following Washington County Land Use Districts: — Transit Oriented Residential District 18-24 units per acre (TO: R18-24) — Transit Oriented Residential District 24-40 units per acre (TO: R24-40) — Transit Oriented Residential District 40-80 units per acre (TO: R40-80) — Transit Oriented Residential District 80-120 units per acre (TO: R80-120) The assignment of City land use and zoning designations to the portion of the property in the County’s TO: R18-24 Land Use District requires a Type 3 Discretionary Procedure. City staff’s preliminary recommendation is to apply the City’s Station Community (SC) land use designation and the Station Community – High Density Residential District (SC-HDR) zone to this portion of the property. This recommendation will be reviewed by Planning Commission at the public hearing on October 27, 2021. A list of uses that may be allowed in the SC-HDR zone can be found in Section 20.20.20 of the Beaverton Development Code. The assignment of City land use and zoning designations to the portions of the property in the County’s TO: R24-40, TO: R40-80, and TO: R80-120 Land Use Districts requires a Type 1 Non-Discretionary Procedure, which means the decision to apply a specific land use designation or zone is made under land use standards that do not require interpretation or the exercise of policy or legal judgment. The decision-making authority for this Type 1 Procedure is City Council, and the Type 1 part of this application will not be reviewed by Planning Commission at the public hearing on October 27, 2021. If the annexation is approved by City Council, the portions of the property in the County’s TO: R24-40, TO: R40-80, and TO: R80-120 Land Use Districts will be automatically assigned the City’s SC land use designation and SC-HDR zone. The subject property abuts the Central Beaverton NAC. The applicable approval criteria for the Type 3 Discretionary Procedure can be found in Comprehensive Plan Section 1.5.1.B and Development Code Section 40.97.15.4. The applicable approval criteria for the Type 1 Non-Discretionary Procedure can be found in Comprehensive Plan Section 1.5.2 and Development Code Section 40.97.15.3. The Planning Commission Meeting can be viewed from the Beaverton Building Council Chambers, and in-person public hearing testimony may be provided on a computer set up in the Beaverton Building. NOTE: The City of Beaverton has declared a State of Emergency due to COVID-19 and the Community Development Department is closed to the public until further notice. The Community Development Department is evaluating temporary changes to processes and procedures to respond appropriately to the COVID-19 State of Emergency and is committed to ensuring that the land use review process continues to fulfill the requirements of state and local law while protecting the health and well-being of the community. Pursuant to Section 50.88 of the Beaverton Development Code, for written comments or exhibits to be submitted by staff at the hearing, they must be received by the project planner no later than 4:30 p.m. on the day of the scheduled hearing. To be made a part of the written staff report, correspondence needs to be received by October 12, 2021. All written testimony provided prior to the meeting will be provided to the Planning Commission prior to their decision. Please reference the Case File Number and Project Name in your written comments. Comments are encouraged to be provided via email to the project planner. A copy of all documents and evidence submitted by or on behalf of the applicant, and applicable review criteria, are available for inspection. The Planning Commission shall conduct hearings in accordance with adopted rules of procedure and shall make a decision on the development application after the hearing closes. Failure to raise an issue in a hearing, by testifying in person or by letter, or failure to provide statements or evidence with sufficient specificity to afford the decision-making authority an opportunity to respond to such issue, precludes appeal to the Land Use Board of Appeals on the issue.
