Pursuant to Section 50.50.5 of the Beaverton Development Code, public notice of the following application is being provided: OPEN AIR BEAVERTON TEXT AMENDMENT (TA2021-0005) The City proposes to amend the Beaverton Development Code (BDC) by adding a definition for the Open Air Beaverton program, and exempting the program from certain land use applications and development standards. The proposal is anticipated to affect BDC Chapters 20, 40, 60, 70, and 90, but may affect other chapters as necessary. The applicable approval criteria for the proposed Text Amendment can be found in BDC Section 40.85.15.1.C. NOTE: The City of Beaverton has declared a State of Emergency due to COVID-19 and the Community Development Division is closed to the public until further notice. The Community Development Department is evaluating temporary changes to processes and procedures to respond appropriately to the COVID-19 State of Emergency and is committed to ensuring that the land use review process continues to fulfill the requirements of state and local law while protecting the health and wellbeing of the community. During this State of Emergency, staff strongly encourages you to submit any testimony comments or questions via email to the Project Planners. Pursuant to Section 50.88 of the Beaverton Development Code, written comments or exhibits submitted prior to the hearing to be submitted by staff at the hearing must be received by the City Recorder no later than 5:00 p.m. on the day of the scheduled hearing. The Planning Commission shall conduct hearings in accordance with adopted rules of procedure and shall make a recommendation on the application after the hearing closes that will be forwarded to the City Council for a final decision. Failure to raise an issue in a hearing, by testifying in person or by letter, or failure to provide statements or evidence with sufficient specificity to afford the decision making authority an opportunity to respond to such issue, precludes appeal to the Land Use Board of Appeals on the issue.
