CITY OF HILLSBORO NOTICE OF PUBLIC HEARING CASE FILE NO.: MOD-013-21 BUTTERNUT CREEK NOTICE IS HEREBY GIVEN that a public hearing will be held before the Planning Commission through a Zoom virtual meeting at or shortly after 6:00 pm, on Wednesday, November 10, 2021. The Planning Commission will consider a request for Modification to an approved Planned Unit Development (PUD) known as Butternut Creek (Case File No.: PUD-010-16) that obtained approval in April 2017. The applicant requests Major Modification approval to adjust the setbacks on a portion of the lots in Phases 6 and 9. Due to a change in housing design(s) that were not anticipated at the time of the original PUD application and the limited space available on the approved blocks, the applicant would like to update the approved setbacks for the approved Type B detached alley-loaded lots. The subject properties can be specifically identified as Tax Lots 3100, 3300, 3600 and 3800 on Washington County Assessor’s Tax Map 1S2-14, and is generally located north of SW Murphy Lane, south of SW McInnis Lane, east and west of SE Cornelius Pass Road. The properties are owned by Pahlisch Homes at Butternut Creek Limited Partnership and Hagg Lane LLC, the applicant is Pahlisch Homes, Inc. and the applicants representative is Melissa Slotemaker, AKS Engineering & Forestry, LLC. The applicable approval criteria for this PUD may be found in Section 12.80.10 of the Community Development Code (CDC). Testimony received after 8:00 am on the day of the hearing will be forwarded to the Planning Commission either before or during the meeting. Please note that Planning Commission may have limited time to review any written testimony received after 8:00 am on the day of the public hearing. Please reference the case file no. on all written testimony. Teleconference Testimony: You may pre-register to speak during the hearing by providing your name, phone number, address, and Zoom account name to via email at planning_dept@hillsboro-oregon.gov prior to 5:00 pm on the day of the hearing. Your information will not be shared at the hearing. If you pre-register and provide your contact information, the City will mail you a copy of the notice of decision once the hearing is closed and a decision has been rendered. At the hearing, the Planning Commission President may read down the list of those who pre-registered. If you were unable to pre-register prior to the meeting, you may email planning_dept@hillsboro-oregon.gov during the hearing to request to speak. You will have three minutes to speak once called upon. Members of the public using Zoom will not be able to share their screen during the meeting; presentation materials should be submitted as written testimony by 5:00 pm on the day of the hearing to planning_dept@hillsboro-oregon.gov. Testimony should avoid repetition of issues, and should be based on the application or on the approval criteria listed above. Oregon Revised Statutes (ORS) 197.763 provides that under certain circumstances, the record may remain open or a continuance may be granted upon the request of a participant. Telephone conversations cannot be accepted as testimony. Pursuant to ORS 197.763, failure to raise an issue at the final evidentiary hearing, or by close of the record, in person or by letter, or failure to provide statements or evidence sufficient to afford the decision maker an opportunity to respond to the issue precludes appeal to the Land Use Board of Appeals based on that issue.
