CITY OF HILLSBORO NOTICE OF PUBLIC HEARINGS CASE FILE NOS. AN-003-21 & ZC-004-21: T5 DATA CENTER NOTICE IS HEREBY GIVEN that two public hearings will be held before the City Council through a Zoom virtual meeting at or shortly after 6:00 pm, on Tuesday, November 16, 2021. The City Council will consider a request for annexation of one property approximately 8.46 acres in size into the City limits of Hillsboro. Upon receipt of the Annexation, the City initiated a Zone Change application to apply the City’s I-S Industrial Sanctuary zone as the base zone upon annexation. The purpose for annexation is to facilitate an expansion of the data center that is under construction on the abutting property to the south. The subject property can be specifically identified as Tax Lot 2201 on Washington County Assessor’s Tax Map 1N2-21, and is generally located north of NE Evergreen Road, south of NE Huffman Road, west of NE Starr Boulevard and east of NE 30th Avenue. The property owner is Christopher Hunter, and the applicant is Frank Lyles, T5 Data Centers. The applicable criteria for an Annexation are listed in Metro Code Chapters 3.09.045 and 3.09.050 and Section 12.80.010 of the Community Development Code (CDC). The applicable criteria for a Zone Change are listed in CDC Section 12.80.168. The CDC may be viewed online at www.hillsboro-oregon.gov/communitydeveloPMentcode or in the Planning Department office. Annexation of the properties would also include its withdrawal from the Tualatin Valley Fire and Rescue Service District and annexation to the Clean Water Services District. Prior to being posted on the City’s website, the City Council staff report for the Annexation will be available after 4:00 pm on Monday, November 1, 2021, and the staff report for the Zone Change will be available after 4:00 pm on Tuesday, November 9, 2021. All interested persons are invited to attend this virtual hearing on Zoom and will be given an opportunity to be heard concerning the proposal. Testimony received after 8:00 am on the day of the hearing will be forwarded to the City Council either before or during the meeting. Please note that City Council may have limited time to review any written testimony received after 8:00 am on the day of the hearing. Please reference the case file no. on all written testimony. Teleconference Testimony: You may pre-register to speak during the hearing by providing your name, phone number, address, and Zoom account name to via email at council@hillsboro-oregon.gov prior to 5:00 pm on the day of the hearing. Your information will not be shared at the hearing. If you pre-register and provide your information, the City will be able to mail you a copy of the notice of decision once the hearing is closed and a decision has been rendered. At the hearing, the Mayor may read down the list of those who pre-registered. If you were unable to pre-register prior to the meeting, you may email council@hillsboro-oregon.gov during the hearing to request to speak. You will have three minutes to speak once called upon. Members of the public using Zoom will not be able to share their screen during the meeting; presentation materials should be submitted as written testimony by 5:00 pm on the day of the hearing to council@hillsboro-oregon.gov. Testimony should avoid repetition of issues and should be based on the application or on the approval criteria listed above. Oregon Revised Statues (ORS) 197.763 provides that under certain circumstances, the record may remain open or a continuance may be granted upon the request of a participant. Telephone conversations cannot be accepted as testimony. General comments, requests and inquiries, not related to the hearing, can be emailed to planning_dept@hillsboro-oregon.gov. Pursuant to ORS 197.763, failure to raise an issue at the final evidentiary hearing, or by close of the record, in person or by letter, or failure to provide statements or evidence sufficient to afford the decision maker an opportunity to respond to the issue precludes appeal to the Land Use Board of Appeals based on that issue.
