CITY OF HILLSBORO NOTICE OF PUBLIC HEARINGS CASE FILE NOS.: AN-004-21 & ZC-005-21 McInnis NOTICE IS HEREBY GIVEN that two public hearings will be held before the City Council through a Zoom virtual meeting at or shortly after 6:00 pm, on Tuesday, November 16, 2021. The City Council will consider a request annexation of two properties approximately 8.77 acres in size into the City limits of Hillsboro. The City has initiated a Zone Change (Case File No.: ZC-005-21) and is also requesting to amend the Comprehensive Plan Map. The Zone Change would change the current zoning designation of County FD-20 Future Development and would apply City zoning of SFR-6 Single Family Residential and SFR-4.5 Single Family Residential. Additionally, the City is proposing to amend the Comprehensive Plan Designation on one Tax Lot (Tax Lot 2402) changing the current Plan Designation from RM Medium Density Residential to RL Low Density Residential. This will correct the Comprehensive Plan Map to reflect the current proposed alignment of SE Cornelius Pass Road. The Community Development Code (CDC) includes special regulations for overlay zones, which are part of the official Zoning Map and are applied through City Council ordinances under procedures that are similar to those for base zones. The present zone change would also apply the Significant Natural Resource Overlay to portions of the properties. The purpose for annexation is to facilitate future extension of SE Cornelius Pass Road. The subject properties can be specifically identified as Tax Lots 2402 and 2404 on Washington County Assessor’s Tax Map 1N2-14, and is generally located north of SE Cornelius Pass Road, south of SE McInnis Street, and west of SW 209th Avenue. The property owners are Neal McInnis Family Trust and Malcolm McInnis Family Trust, and the applicant is Pahlisch Homes, Inc. The applicable criteria for an Annexation are listed in Metro Code Chapters 3.09.045 and 3.09.050 and Section 12.80.010 of the Community Development Code (CDC). The applicable criteria for a Zone Change are listed in CDC Section 12.80.168. The CDC may be viewed online at www.hillsboro-oregon.gov/communitydeveloPMentcode or in the Planning Division office. Annexation of the properties would also include its withdrawal from the Tualatin Valley Fire and Rescue Service District and annexation to the Clean Water Services District. Members of the public using Zoom will not be able to share their screen during the meeting; presentation materials should be submitted as written testimony by 5:00 pm on the day of the hearing to council@hillsboro-oregon.gov. Testimony should avoid repetition of issues and should be based on the application or on the approval criteria listed above. Oregon Revised Statues (ORS) 197.763 provides that under certain circumstances, the record may remain open or a continuance may be granted upon the request of a participant. Telephone conversations cannot be accepted as testimony. Pursuant to ORS 197.763, failure to raise an issue at the final evidentiary hearing, or by close of the record, in person or by letter, or failure to provide statements or evidence sufficient to afford the decision maker an opportunity to respond to the issue precludes appeal to the Land Use Board of Appeals based on that issue.
