PLANNING COMMISSION PUBLIC HEARING NOTICE IS HEREBY GIVEN: That the City of Fairview Planning Commission will hold a public hearing at 6:30 pm on Tuesday, July 12, 2022 to review the following land use application. The meeting will be held in the Council Chambers at Fairview City Hall, located at 1300 NE Village Street, Fairview, Oregon. Interested persons are invited to appear and testify on the proposals. Information on testifying remotely will be available on the meeting agenda and City calendar. See: https://fairvieworegon.gov/207/Planning-Commission Planning application file number 2022-40-ZC-CPA-CUP and Ordinance 7-2022 This is a consolidated application to change the land use designation for six tax lots owned by the Slavic Evangelical Church located along NE Sandy Blvd. (tax lots 1N3E28BB-00100, 00200, 00400, 00505, 00506, and 13200; 10.2 acres total). Amendments are proposed to change the Light Industrial (LI) Zoning designation to Corridor Commercial (C-C) zoning and to amend the Comprehensive Plan Map designation from Industrial to Commercial. The application also seeks conditional use approval for a K-12 school within the existing church building. The Planning Commission will review the above application and make a recommendation to the City Council. The City Council will consider the Planning Commission’s recommendation at a first reading to be held on July 20, 2022 and second reading and public hearing on August 3, 2022. The City Council may make a final decision regarding the above application at the public hearing on August 3. If the City Council renders a decision, it will be mailed to anyone who submitted written comments, provided public testimony, or who is otherwise legally entitled to notice. Public testimony must be limited to the findings of fact in the staff report, the above criteria or other City or State applicable land use standards. Only those persons who submit written comments or appear in person before the Hearing Authority may appeal the decision. The failure to raise an issue with sufficient specificity to afford the decision-maker and the parties an opportunity to respond may preclude an appeal based on that issue to the State Land Use Board of Appeals (LUBA), and it may preclude damages in Circuit Court. Copies of the written testimony or comments and all documents submitted by or on behalf of the applicant are available for inspection at Fairview City Hall. A copy of the staff report will be available seven days before the hearing. Copies of the staff report and application-related materials can be obtained at a reasonable cost from the City.
