NOTICE OF PUBLIC HEARING FOR ALLEY VACATION NOTICE IS HEREBY GIVEN that on Thursday, August 4, 2022, at 7:00 pm, the Gervais City Council will conduct a public hearing to consider the following alley vacation petition. FILE No.: Alley Vacation #VAC 2021-02 APPLICANT: Scott Mickalson, 775 Hemlock Avenue in Gervais PETITION: Applicant submitted a petition, along with all required signatures, to vacate the 20-foot by 200-foot public alley within Block 68 of the Gervais Plat, bound by Ivy Avenue, Hemlock Avenue, 7th Street, and 8th Street. The applicant requests the public alley vacation to increase the yards of the abutting houses. PROCEDURE: An alley vacation is a process through which the City abandons public jurisdiction of a right-of-way. If approved by the City Council, the former alley is divided down the center and the land is attached to the abutting private properties. Utility easements may be reserved if applicable. Vacation procedures are detailed in Oregon Revised Statutes (ORS) Chapter 271, Gervais Development Code 17.132.030, 17.176.020, 17.180.020. Persons wishing to speak for or against the petition may submit testimony in several different ways. City Council meetings are hosted in a hybrid format. The public may attend in person, by representative, or appear remotely via the Zoom online meeting platform by phone or video. Additionally, written testimony will be received prior to the hearing at the City of Gervais, 592 4th Street, P. O. Box 329, Gervais, OR 97026. Failure to raise an issue at the hearing, in person or by letter, or failure to provide sufficient specificity to afford the decision-makers an opportunity to respond to the issue precludes appeal of the City Council’s decision to the Oregon Land Use Board of Appeals (LUBA). A copy of the Alley Vacation petition application and staff report will be available one week prior to the public hearing for inspection at no cost, and provided at reasonable cost.
