NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS July 21, 2022, City of Hillsboro 150 E Main St., Hillsboro, OR 97123 – (503) 681-6200 On or about July 31 2022, the City of Hillsboro Community Development Department will authorize Family Promise to submit a request to the US Department of Housing and Urban Development (HUD) for the release of Community Development Block Grant (CDBG) funds under Title I of the Housing and Community Development Act of 1974, 42 USC 301 et seq as amended, and the National Affordable Housing Act of 1990, as amended to undertake the following project: Family Promise – Facility Improvements for the purpose of improving the agency’s facility located in Hillsboro which serves persons who are homeless. The project activities will include ADA upgrades, Lead Paint abatement, Code Upgrades, and kitchen remodeling to include new appliances. Bathroom remodels (one on each floor), Laundry room renovation and new appliances, Electrical wiring upgrades, and all-new lighting (external and internal). Painting of the entire space, new flooring, and carpeting. Installation of Security Systems and Perimeter Lighting Installation of Emergency Evacuation Devices throughout the facility. $150,000 in CDBG funds will be used to pay for construction costs associated with the project. The activities proposed are categorically excluded under HUD regulations at CFR Part 58 from the National Environmental Policy Act (NEPA) requirements but could not convert to exempt because the property is eligible for the National Register of Historic Places, the State Historic Preservation Offices concurs that based on the scope of work identified the proposed activities are not likely adversely affect the historic character of this former residence. Additional project information is contained in the Environmental Review Record (ERR) on file for review at City of Hillsboro Community Development Department, 150 E Main St. Hillsboro, OR 97123 and may be reviewed or copied weekdays 8AM to 5PM. PUBLIC COMMENT – Any individual, group, or agency may submit written comments on the ERR to the City of Hillsboro Community Development Department. All comments received by July 30, 2022, will be considered by the Community Development Department prior to authorizing submission for a request of release of funds. RELEASE OF FUNDS – The City of Hillsboro Community Development Department certifies to HUD that Robby Hammond in his capacity as City Manager consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and Family Promise to use Program funds. OBJECTIONS TO RELEASE OF FUNDS – HUD will accept objections to its release of funds and the City of Hillsboro’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Hillsboro; (b) the City of Hillsboro has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred cost not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to HUD at the Oregon State HUD Office, Edith Green-Wendell Wyatt Federal Building, 1220 SW 3rd Ave, Suite 400, Portland, OR 97204.
