PUBLIC NOTICE NOTICE OF INTENT to REQUEST RELEASE OF FUNDS July 28, 2022 Clackamas County Housing and Community Development Division 2051 Kaen Road, Suite 245 Oregon City, Oregon 97045 (503) 655-8591 On or about August 15, 2022 Clackamas County will submit a request to the U.S. Department of Housing and Urban Development (HUD) Portland Field Office for the release of CDBG funds under Title I of the Housing and Community Development Act of l974 (PL 93-383) to undertake the following project: Broad Review Program Title: Clackamas County Housing Rehabilitation Program 2022-2026 Purpose: To provide assistance to low and very low-income households within Clackamas County to make necessary repairs and renovations to their residential dwellings. Location: Clackamas County, countywide. Specific addresses will be assessed in the site specific reviews. Program Description: Activities under this tiered review will be limited to single family and duplex dwellings. Activities may include (singularly or in combination) roof repair, electrical, plumbing, HVAC, framing, painting, door and window replacement, weatherization improvements, accessibility improvements, foundation repairs, repair or replacement of fixtures, repair of the grounds (walkways, retaining walls), sewer repairs and connectivity, installation of security, phone and internet systems and other typical housing repair and rehabilitation activities. Sub-programs covered under this tiered review include: DPL-full rehab, Critical Home Repair Program, Sewer Hook-up Grant, Housing Access Grant, Single Purpose Grant, and the Roof Repair Program. Site Specific Reviews will be completed for those laws and authorities not addressed in the broad review for each address under this program when addresses become known. Level of Environmental Review Citation: 24 CFR Part 58.35(a)(3)(i) Site Specific Review: The site specific reviews will cover the following laws and authorities not addressed in the broad review: National Historic Preservation Act of 1966 (particularly sections 106 and 110; 36 CFR part 800), Flood Disaster Protection Act of 1973 and National Flood Insurance Reform Act of 1994 (42 USC 4001-4128 and 42 USC 5154a), Floodplain Management Executive Order 11988 (particularly section 2(a); 24 CFR part 55), Hazardous and Toxic Substances (24 CFR 50.3(i)(2)) Mitigation Measures/Conditions/Permits: Ground disturbance, if any, will be limited to areas previously disturbed by construction activities. Estimated Project Cost: Between $5,000 and $35,000 of CDBG assistance per property. Total five-year estimated program cost is $3,000,000. The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements per 24 CFR part 58.35(a)(3)(i). An environmental review record (ERR) that documents the environmental determinations for this project is on file at Clackamas County, Community Development Division, 2051 Kaen Road, Suite 245, Oregon City, OR 97045 and may be examined or copied Monday – Thursday 8am to 5pm. PUBLIC COMMENTS Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to Clackamas County Community Development Division at the above address. All comments received by 5pm on August 26, 2022 will be considered by Clackamas County prior to authorizing submission of a request for release of funds. RELEASE OF FUNDS Clackamas County certifies to HUD that Clackamas County and Mark Sirois, in his capacity as Community Development Manager and Certifying Officer, consent to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows Clackamas County to use HUD Program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of funds and Clackamas County’s certification received by September 1, 2022 or a period of fifteen days from its receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer or other officer of Clackamas County approved by HUD; (b) Clackamas County has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD/State; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD CPD, 1220 SW 3rd Avenue, Suite 400, Portland, OR 97204-2825. Potential objectors should contact HUD to verify the actual last day of the objection period.
