Notice of City Measure and Receipt of Ballot Title

NOTICE OF CITY MEASURE ELECTION AND RECEIPT OF BALLOT TITLE CITY OF ESTACADA, OREGON NOTICE IS HEREBY GIVEN that a ballot title for a measure referred by the City Council of the City of Estacada was filed with the City Elections Officer on August 3, 2022, for an election to be held on Tuesday, November 8, 2022. The election shall be conducted by mail pursuant to ORS 254.465 and ORS 254.470. CAPTION: Temporary Prohibition on Psilocybin-related businesses within Estacada. QUESTION: Shall Estacada prohibit Psilocybin-related businesses for two years so that local regulations can be adopted for the businesses? SUMMARY: State law allows for operation, manufacturing, and distribution of Psilocybin related businesses. The State will begin issuing permits for these businesses in 2023, unless a City has a permanent or temporary prohibition in place. There is disagreement about what type of time, place, and manner restrictions cities can place on the Psilocybin businesses. However, State law provides that a City Council may adopt an ordinance to be referred to the voters to prohibit the establishment of any of those registered or licensed activities. Approval of this measure would prohibit the establishment of Psilocybin manufacturers and other Psilocybin related businesses for a two-year period ending on December 31, 2024, unless Estacada voters extend the ban prior to its expiration. During the ban period the City could do public outreach to help determine what, if any, limitations can be placed on these businesses and if there is public support for locating or prohibiting these businesses in Estacada. An elector of the city who is dissatisfied with the Caption may file a petition for review with the Clackamas County Circuit Court no later than the seventh business day after the date the title was filed with the City Elections Officer.
