NOTICE OF BALLOT TITLE CITY INITIATED MEASURE PROHIBITING PSILOCYBIN-RELATED BUSINESSES IN BANKS. PROHIBITION SUNSETS AFTER 2 YEARS NOTICE IS HEREBY GIVEN that a ballot title for a measure referred by the Banks City Council has been filed with the City of Banks Election Office on August 10, 2022. NOTICE IS FURTHER GIVEN that the Banks City Recorder has determined that the proposal contains only one subject, as required by section 1(2)(d), Article IV of the Oregon Constitution. NOTICE IS FURTHER GIVEN that the Banks City Attorney has submitted the following ballot title for the proposal: BALLOT TITLE CAPTION: Prohibits psilocybin-related businesses in Banks. Prohibition sunsets after 2 years. BALLOT TITLE: Prohibits psilocybin-related businesses in Banks. Prohibition sunsets after 2 years. QUESTION: Shall Banks prohibit psilocybin-related businesses in the City for 2 years? SUMMARY: State law allows operation, manufacture, distribution and possession of psilocybin. State law provides that a city council may adopt an ordinance to be referred to the voters that prohibits the establishment of any of those registered or licensed activities for 2 years. Approval of this measure would prohibit the establishment of psilocybin product manufacturers and psilocybin service center operators within the City of Banks until December 24, 2024. EXPLANATORY STATEMENT: Approval of this measure would prohibit the establishment and operation of psilocybin-related businesses within the city for 2 years. The city council may adopt an ordinance prohibiting the establishment of psilocybin related businesses within the city, but the council must refer the ordinance to the voters at a statewide general election. The Banks City Council adopted Ordinance 2022-08-01 on August 9, 2022, which prohibits the establishment of psilocybin-related businesses within the city and referred the measure to the voters.
