COUNCIL BILL NO. 3135 RESOLUTION NO. 2160 A RESOLUTION ADDRESSING FAIR HOUSING ASSISTANCE IN THE CITY OF WOODBURN, AS REQUIRED BY THE OREGON COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM AND THE UNITED STATEMENT DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT; AND REPEALING AND REPLACING RESOLUTION NO. 1346 WHEREAS, discrimination in the sale, rental, lease, advertising of sale, rental or lease, financing of housing or land to be used for construction of housing, or in the provision of brokerage or rental services because of race, color, religion, sex, disability (physical or mental), familial status (children) or national origin is prohibited by Title VIII of the federal Fair Housing Amendments Act of 1988; WHEREAS, It is the policy of the City of Woodburn to support the Fair Housing Amendments Act of 1988 and to implement a Fair Housing Program to ensure equal opportunity in housing for all persons regardless of race, color, religion, sex, disability (physical and mental), familial status (1. children, and 2. actual or perceived sexual orientation, gender identity or marital status or its members), or national origin; WHEREAS, The City of Woodburn is the recipient of a Community Development Block Grant for the FY 2019- 2020; WHEREAS, the Oregon Community Development Program and the United States Department of Housing and Urban Development require that this resolution be adopted to replace the City’ s previously adopted Fair Housing Resolution (No. 1346); NOW, THEREFORE, THE CITY OF WOODBURN RESOLVES AS FOLLOWS: Section 1. That within the resources available to the City through city, county, state, federal and community volunteer sources, the City of Woodburn will assist all persons who feel they have been discriminated against because of race, color, religion, sex, disability (physical and mental), familial status (children) or national origin in the process of filing a complaint with the Oregon Civil Rights Division or the U. S. Department of Housing and Urban Development, Seattle Regional Office Compliance Division, that they may seek equity under federal and state laws. Section 2. That the City shall publicize this Resolution and through this publicity shall cause real estate brokers and sellers, private home sellers, rental owners, rental property managers, real estate and rental advertisers, lenders, builders, developers, home buyers and home or apartment renters to become aware of their respective responsibilities and rights under the Fair Housing Amendments Act of 1988 and any applicable state or local laws or ordinances. Section 3. THE FAIR HOUSING PROGRAM, for the purpose of informing those affected of their respective responsibilities and rights concerning Fair Housing law and complaint procedures, will at a minimum include, but not be limited to: 1) the printing, publicizing and distribution of this Resolution; 2) the distribution of posters, flyers, pamphlets and other applicable Fair Housing information provided by local, state and federal sources, through local media of community contacts; and 3) the publicizing of locations where assistance will be provided to those seeking to file a discrimination complaint. Section 4. The City’ s previously adopted Fair Housing Resolution (No. 1346) is hereby repealed and replaced upon adoption of this Resolution. DATED August 10, 2020. Published September 21, 2022.WI257013 PROYECTO DEL LEY DEL CONSEJO NM. 3135 RESOLUCIN NM. 2160 RESOLUCIN SOBRE LA ASISTENCIA DE VIVIENDA EQUITATIVA EN LA CIUDAD DE WOODBURN, SEGN LO REQUIERE EL PROGRAMA DE SUBVENCIN EN BLOQUE PARA EL DESARROLLO DE LA COMUNIDAD DE OREGN Y EL DEPARTAMENTO DE VIVIENDA Y DESARROLLO URBANO DE LOS ESTADOS UNIDOS; Y DEROGANDO Y SUSTITUYENDO LA RESOLUCIN NO. 1346 CONSIDERANDO, que la discriminacin en la venta, el alquiler, la publicidad del alquiler o la financiacin de viviendas o de terrenos que se van a utilizar para la construccin de viviendas, o en la prestacin de servicios de intermediacin o de alquiler por motivos de raza, color, religin, sexo, discapacidad (fsica o mental), situacin familiar (hijos) o nacionalidad est prohibida por el Ttulo VIII de la Ley federal de Enmiendas a la Vivienda Equitativa de 1988; CONSIDERANDO, Es la poltica del Ayuntamiento de Woodburn para apoyar la Ley de Enmiendas de Vivienda Equitativa de 1988 y para implementar un Programa de Vivienda Equitativa para garantizar la igualdad de oportunidades de vivienda para todas las personas, independientemente de su raza, color, religin, sexo, discapacidad (fsica y mental), estado familiar (1. los nios, y 2. real o percibida la orientacin sexual, identidad de genero o estado civil o sus miembros), o el origen nacional; CONSIDERANDO, Que el Ayuntamiento de Woodburn es el beneficiario de una Subvencin en Bloque de Desarrollo Comunitario para el ao fiscal 2019-2020; 2021-2023; CONSIDERANDO, Que el Programa de Desarrollo Comunitario de Oregn y el Departamento de Vivienda y Desarrollo Urbano de los Estados Unidos exigen que se adopte esta resolucin para reemplazar la Resolucin de Vivienda Equitativa previamente adoptada por el Ayuntamiento (No. 1346); AHORA, POR LO TANTO, EL AYUNTAMIENTO DE WOODBURN RESUELVE LO SIGUIENTE: Seccin 1. Que dentro de los recursos disponibles para el Ayuntamiento a traves de la ciudad, el condado, el gobierno federal y las fuentes de voluntariado de la comunidad, el Ayuntamiento de Woodburn ayudar a todas las personas que sientan que han sido discriminadas por motivos de raza, color, religin, sexo, discapacidad ( fsica y mental), estado familiar (nios) u origen nacional en el proceso de presentar una queja con la Divisin de Derechos Civiles de Oregon o el Departamento de Vivienda y Desarrollo Urbano de los Estados Unidos, Divisin de Cumplimiento de la Oficina Regional de Seattle, para que puedan buscar equidad bajo las leyes federales y estatales. Seccin 2. Que el Ayuntamiento dar publicidad a esta Resolucin y a traves de esta publicidad har que los agentes de bienes races y los vendedores, los propietarios de viviendas privadas, los propietarios de alquileres, los administradores de propiedades de alquiler, los publicistas de bienes races y de alquileres, los prestamistas, los constructores, los promotores, los compradores de viviendas y los inquilinos de casas o apartamentos tomen conciencia de sus respectivas responsabilidades y derechos en virtud de la Ley de Enmiendas a la Vivienda Equitativa de 1988 y cualquier ley u ordenanza estatal o local aplicable. Seccin 3. EL PROGRAMA DE VIVIENDA EQUITATIVA, con el propsito de informar a los afectados de sus respectivas responsabilidades y derechos en relacin con la ley de Vivienda Equitativa y los procedimientos de queja, incluir como mnimo, pero no se limitar a: 1) la impresin, la publicidad y la distribucin de esta Resolucin; 2) la distribucin de carteles, volantes, folletos y otra informacin aplicable de Vivienda Equitativa proporcionada por fuentes locales, estatales y federales, a traves de los medios de comunicacin locales de los contactos de la comunidad; y 3) la publicidad de los lugares donde se proporcionar asistencia a aquellos que buscan presentar una queja de discriminacin. Seccin 4. La Resolucin de Vivienda Equitativa (Nm. 1346) adoptada anteriormente por el Ayuntamiento queda derogada y reemplazada tras la adopcin de la presente Resolucin.
