TRUSTEE’S NOTICE OF SALE Carmen Velazquez, as Grantor, made, executed, and delivered to Ticor Title Company of Oregon, as Trustee (Sherman, Sherman, Johnnie and Hoyt, LLP is now the duly appointed Successor Trustee), in favor of North Willamette Valley Habitat for Humanity, Inc., an Oregon non-profit corporation, as Beneficiary, that certain trust deed dated August 18, 2021, and recorded on August 20, 2021, at Reel 4530, Page 60, in the Records of Marion County, Oregon (the Trust Deed), covering the following described real property situated in said County and State: Beginning at an iron pipe in the North line of Young Street 177.0 feet North 60deg. 6′ West from the intersection of the North line of Young Street extended and the center line of the Pacific Highway, which point of beginning is also the Southwest corner of a tract of land conveyed to Clarence S. D. Smith by deed recorded in Volume 173, Page 195, Deed Records for Marion County, Oregon; thence North 32deg. 19′ East along the Westerly line of said Smith Tract 246.3 feet, more or less, to the Northwest corner of said Smith Tract, said point also being on the South line of a tract of land conveyed to George C. Adams and Laverne M. Adams by deeds recorded March 17, 1936, in Volume 224, Pages 242 and 243 of Deed Records; thence North 60deg. 2′ West along the South line of said Adams Tract 55.0 feet, more or less, to the Southwest corner of said Adams Tract; thence South 32deg. 19′ West along the right of way granted by the conveyances recorded in Volume 224, Page 242 and 243, of Deed Records, 246.80 feet to the North line of Young Street; thence South 60deg. 6′ East along the North line of Young Street 54.8 feet to the point of beginning, being situated in the City of Woodburn, Marion County, Oregon. SAVE AND EXCEPT that portion of the above described real property conveyed to the City of Woodburn, by deed recorded June 15, 1988, in Reel 625, Page 437, Microfilm Records, Marion County, Oregon. The Beneficiary and the Trustee have elected to sell the real property to satisfy the obligations secured by the Trust Deed and a notice of default has been recorded pursuant to ORS 86.752(3); the default for which the foreclosure is made is failure to pay according to the terms of the promissory note, secured by the Trust Deed described herein, namely: $85,000.00 principal due at maturity on September 1, 2022; $8,259.40 Accrued and unpaid interest through April 1, 2023; $4,538.50 late fees; $97,797.90, Total amount past due April 1, 2023. By power given the Beneficiary under the Trust Deed, Beneficiary herewith declares all sums due under the Trust Deed to be immediately due, owing, and payable without further demand. The true amount due and owing the Beneficiary by the Grantor herein, is as follows: $85,000.00 (principal); $8,259.40 (accrued, unpaid interest to April 1, 2023), $4,358.50, (late charges); $405.00 (foreclosure guaranty); $98,022.90, Balance due on Trust Deed as of April 1, 2023, plus interest accruing after April 1, 2023, at the rate of 8% per annum, attorney’s fees, and trustee’s fees; together with any other sums due or that may become due under the Note or Trust Deed, or by reason of the default, this foreclosure and any further advances made by Beneficiary as allowed by the Note and Trust Deed. Notice is hereby given that the undersigned will on Tuesday, August 15, 2023, at 9:00 o’clock a.m., Pacific Time, on the front steps of the Marion County Courthouse, 100 High street NE, Salem, Oregon, sell at public auction to the highest bidder for cash the interest in the said described real property which the Grantor had or had power to convey at the time of the execution by her of the Trust Deed, to satisfy the foregoing obligations thereby secured and the costs and expenses of sale, including a reasonable charge by the trustee. Notice is further given that any person named in ORS 86.778 has the right to have the foreclosure proceeding dismissed and the Trust Deed reinstated by payment of the entire amount due (other than such portion of said principal as would not then be due had not default occurred), together with costs, trustee’s and attorney’s fees as provided by ORS 86.778, and by curing any other default complained of herein that is capable of being cured by tendering the performance required under the obligation of the Trust Deed at any time prior that is not later than five (5) days before the date set for said sale. Without limiting the trustee’s disclaimer of representations or warranties, Oregon law requires the trustee to state in this notice that if any of the above-described real property is residential property, then some residential property sold at a trustee’s sale may have been used in manufacturing methamphetamines, the chemical components of which are known to be toxic.
