NOTICE OF PUBLIC HEARING BEFORE THE CITY COUNCIL Ordinance 2939 Hearing Date, Time, and Location: Tuesday, October 17, 2023; 4:15 p.m. City Council Chambers – 3rd Floor 380 A Avenue Lake Oswego, OR 97034 This meeting will be conducted both in-person at City Hall or virtually via Zoom. Several avenues are available to the public for viewing this Public Hearing or participating remotely. File Number: Ordinance 2939 Petitioner: City of Lake Oswego Nature of Hearing: The Lake Oswego City Council will hold a public hearing at the above date, time and location to consider Ordinance 2939, vacating the public interest in that portion of a 6-foot wide Pathway that Is located along the northwesterly right-of-way of Union Pacific Railroad from Boones Ferry Road northeasterly approximately 759 Feet to the westerly line of 5014 Upper Drive. The public will have the opportunity to comment on Ordinance 2939. If the City Council approves the street vacation, it will enact Ordinance 2939 implementing the street vacation. The title of Ordinance 2939 is as follows: Ordinance 2939 A SPECIAL ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE OSWEGO VACATING THE PUBLIC INTEREST IN THAT PORTION OF A 6-FOOT WIDE PATHWAY THAT IS LOCATED ALONG THE NORTHWESTERLY RIGHT-OF-WAY OF UNION PACIFIC RAILROAD FROM BOONES FERRY ROAD NORTHEASTERLY APPROXIMATELY 759 FEET TO THE WESTERLY LINE OF 5014 UPPER DRIVE. Time Limits on Testimony: The purpose of time limits on testimony is to provide all interested persons with an adequate opportunity to present and respond to testimony while at the same time ensuring that the hearing can be conducted in an efficient and expeditious manner. The following time limits on testimony shall be observed: — 10 minutes for a representative of a recognized neighbor- hood association, homeowner association, government or government agency, or other incorporated public interest organization; — 5 minutes for other persons. Any person in attendance at the hearing and entitled to testify may cede his or her time for testimony to another person entitled to testify and thereby increase that person’s time for testimony.
