THE UNKNOWN HEIRS AND/OR DEVISEES OF CAM T. PHAM AND THI DO; and PARTIES IN POSSESSION OR CLAIMING A RIGHT TO POSSESSION, Defendants. TO: THE UNKNOWN HEIRS AND/OR DEVISEES OF CAM T. PHAM AND THI DO, of the above-named defendants. You are hereby required to appear and defend the complaint filed against you in the above-entitled action, within thirty (30) days from the date of the first publication of this summons, and in case of your failure to appear and answer, plaintiff for want thereof will apply to the above-entitled court for the relief prayed for in its complaint. SUMMARY STATEMENT: This action relates to Plaintiff’s desire to foreclose its claim for services, labor or materials lawfully chargeable as common expenses, against the real estate described as: Lot 79, FAIRVIEW TERRACE No. 2, in the City of Fairview, County of Multnomah and State of Oregon. WHEREFORE, Plaintiff prays for the following relief: (a) For a general judgment in the amount of $7,295.90, plus all assessments, late fees, fines, interest and other charges due hereunder which have accumulated after August 23, 2023, to date a sheriff’s sale, plus interest thereon at the rate of 18.0% per annum from the date of judgment until paid, and for reasonable attorney fees in an amount to be determined by the court, and costs and disbursements incurred herein; (b) For a general judgment foreclosing its claim of lien against the real property described above and against any interest the Defendants might claim; declaring that the Association’s lien is a first, valid, and subsisting lien against the property that is junior only to tax and assessment liens and any first mortgage or first deed of record and superior to any interest in the property of the Defendants; that the property be sold by the Sheriff of Multnomah County, in a manner provided by law, as on execution, to satisfy the amounts owing; and that the Association be permitted to purchase at the sale; and (c) For such other and further relief as the court may deem just and proper.
