TRUSTEE’S NOTICE OF SALE Loan No: 916008xxxx T.S. No.: 2024-100677 Reference is made to that certain Construction Deed of Trust, Assignment of Rents and Security Agreement (the Original Deed of Trust) made by JENNY STATION LLC, an Oregon limited liability company, as the grantor, in favor of Fidelity National Title Company of Oregon, as the original trustee, for the benefit of Nextres, LLC, a Pennsylvania corporation, as the original beneficiary, which Deed of Trust was dated 1/10/2023, and recorded 1/11/2023, as Instrument No. 2023-001812 in the records of Multnomah County, Oregon. Subsequently the Deed of Trust was re-recorded to correct the name of the beneficiary as Nextres, LLC, a Delaware limited liability company (the Beneficiary), which corrected Deed of Trust was recorded April 10, 2024, as Instrument No. 2024-020395, of the records of Multnomah County, Oregon (the Corrected Deed of Trust and collectively, with the Original Deed of Trust, the Deed of Trust). The Deed of Trust covers the following described real property situated in said County and State, to-wit: Legal Description: See Exhibit A attached hereto and made a part of Personal Property: See Exhibit B attached hereto and made a part of Commonly known as: 2434 SE 92nd Avenue, Portland, OR 97216 APN: R142247 (formerly known as R182800650) Both the Beneficiary and the undersigned trustee have elected to sell the said real property to satisfy the obligations secured by the Deed of Trust and notice has been recorded pursuant to Section 86.735(3) of Oregon Revised Statutes: the default for which the foreclosure is made is the grantor’s failure to pay the following: (i) the unpaid balance of principal which became all due and payable on February 1, 2024, (ii) late charges; (iii) default interest; (iv) taxes and insurance premiums; (v) attorney’s fees and other expenses and costs of collection; and (vi) trustee and foreclosure fees, costs, and expenses. Whereof, notice hereby is given that the undersigned trustee will on 9/17/2024 at the hour of 11:00 AM, Standard of Time, as established by section 187.110, Oregon Revised Statues, at the front entrance to the Multnomah County Courthouse located at 1200 SW First Avenue, Portland, OR 97204, County of Multnomah, State of Oregon, sell at public auction to the highest bidder for cash the interest in the said described real property which the grantor had or had power to convey at the time of the execution by him of the said Deed of Trust, together with any interest which the grantor or his successors in interest acquired after the execution of said Deed of Trust, to satisfy the foregoing obligations thereby secured and the costs and expenses of sale, including a reasonable charge by the trustee. Notice is further given that any person named in Section 86.778 of Oregon Revised Statutes has the right to have the foreclosure proceeding dismissed and the Deed of Trust reinstated by payment to the beneficiary of the entire amount then due (other than such portion of said principal as would not then be due had no default occurred), together with the costs, trustee’s and attorney’s fees and curing any other default complained of in the Notice of Default by tendering the performance required under the obligation or Deed of Trust, at any time prior to five days before the date last set for sale. In construing this notice, the masculine gender includes the feminine and the neuter, the singular includes plural, the word grantor includes any successor in interest to the grantor as well as any other persons owing an obligation, the performance of which is secured by said Deed of Trust, the words trustee and ‘beneficiary include their respective successors in interest
