Nature of Application and Proposed Legislative Amendments:
A request by the City of Lake Oswego for legislative amendments (Ordinance 2695) to the Utility Code (LOC Ch. 38) and Community Development Code (LOC Ch. 50) which are designed to meet requirements of the City’s National Pollution Discharge Elimination System (NPDES) Municipal Separate Storm Sewer System (MS4) permit, and to improve stormwater management practices in development and redevelopment within the City. The Planning Commission considered these proposed amendments at a hearing on November 23, 2015 and December 14, 2015. The Commission recommends that City Council adopt the approved amendments reflected in Attachments A and B to Ordinance 2695.

In addition, the City Council is being asked to consider amendments to sections of LOC Article 52 (Ordinance 2696) to clarify qualifications, expertise and techniques with respect to implementing erosion control permits. This item was not discussed by the Planning Commission as it was not considered to be a land use matter, though it was provided as background material.

Amendments would be implemented through the adoption of Ordinances 2695 and 2696 and attachments, which will be considered at the public hearing. The titles of the ordinances are as follows:

Ordinance No. 2695
An ordinance of the City Council of the City of Lake Oswego amending LOC Sections 38.06.2.c.i, 38.24.5, 50.06.006, 50.60.004, 50.07.003, 50.007.004, and adding Article 38.25, regarding stormwater management; and adopting findings (LU 15-0050).

Ordinance No. 2696
An ordinance of the City Council of the City of Lake Oswego amending LOC Sections 52.02.010, 52.02.020, and 52.04.030, regarding erosion control, to clarify regulation of non-stormwater discharges from construction sites and improve construction site inspection.

The City Council may make a preliminary decision following the hearing. The final City Council decision will be made by adoption of written findings outlining the reasons for the decision. That action usually takes place at the following Council meeting.

Time Limits on Testimony:
The purpose of time limits on testimony is to provide all interested persons with an adequate opportunity to present and respond to testimony while at the same time ensuring that the hearing can be conducted in an efficient and expeditious manner. The following time limits on testimony shall be observed, but may be changed by the Council:
Testimony will be taken in the following order: in support of the amendment, in opposition to the amendment, neutral.
• 10 minutes for a representative of a recognized neighborhood association, homeowner association, government agency, or other incorporated public interest organization;
• 5 minutes for other persons.
