NOTICE IS HEREBY GIVEN that a public hearing will be held before the Hillsboro Planning and Zoning Hearings Board, at or shortly after 6:30 p.m., on Wednesday, April 20, 2016, in the Shirley Huffman auditorium of the Hillsboro Civic Center, 150 East Main Street, Hillsboro. At this hearing, the Board will consider a request for conditional use approval for a new daycare facility in the C-G Commercial General zone, on a property approximately 0.86 acres in size. The proposed daycare facility is approximately 11,571 square feet with an outdoor fenced play area and associated parking, landscaping and utility improvements. The daycare will have capacity for 160 students and 24 employees. The applicant has also submitted a concurrent Development Review application (Case File No. Development Review 007-16), which is contingent upon approval of this Conditional Use application. The property owner and applicant is Elliott Investments, LLC, represented by Ben Altman, Pioneer Design Group.

The subject property is generally located north of NW Jacobson Road, south of NW West Union Road, and west of NW Cornelius Pass Road, and can be specifically identified as Tax Lot 2500 on Washington County Assessor’s Tax Map 1N2-14D. The applicable approval criteria for a Conditional Use application may be found in the Hillsboro Community Development Code (CDC), Section 12.80.020. All interested persons are invited to attend this meeting and will be given an opportunity to be heard concerning the proposal. Oral testimony will be taken in the following order: applicant; other proponents; opponents; and applicant’s rebuttal. ORS 197.763 provides that under certain circumstances, the record may remain open or a continuance may be granted upon the request of a participant. Pursuant to ORS 197.763, failure to raise an issue at the final evidentiary hearing, or by close of the record, in person or by letter, or failure to provide statements or evidence sufficient to afford the decision maker an opportunity to respond to the issue precludes appeal to the Land Use Board of Appeals based on that issue.
