REGULATORY FLOODPLAIN AMENDMENTS

NOTICE IS HEREBY GIVEN that a public hearing will be held before the Hillsboro Planning Commission at or shortly after 6:00 p.m., on Wednesday, August 24, 2016, in the Shirley Huffman auditorium of the Hillsboro Civic Center, 150 East Main Street, Hillsboro. At the hearing, the Planning Commission will consider proposed text and map amendments to the Hillsboro Community Development Code (CDC) regarding the adoption of updated Federal Emergency Management Agency (FEMA) flood maps.

The proposed text and map amendments to the CDC are included within Section 12.27.100, Regulatory Floodplain Overlay, and Section 12.01.500 Definitions. On May 4, 2016 FEMA notified the City that recently updated Flood Insurance Maps must be adopted into the Community Development Code by November 4, 2016 for the City to remain in good standing in the National Flood Insurance Program. The Development Services Division of the Planning Department has identified sections where the current CDC language should be clarified or amended to meet the intent of the regulation or to follow or improve current procedures.

The procedures by which CDC text amendments are processed can be found in the Hillsboro Community Development Code, Sections 12.80.140 and 12.70.060. The CDC may be viewed online at www.hillsboro-oregon.gov/CommunityDevelopmentCode or in the Planning Department office. The complete record and all related criteria are available at the Hillsboro Planning Department for public inspection at no cost, and/or copies can be provided at reasonable cost.

All interested persons are invited to attend this meeting and will be given an opportunity to be heard concerning the proposal. Oral testimony will be taken in the following order: applicant; other proponents; opponents; and applicant’s rebuttal. Oral testimony should avoid repetition of issues, and should be based on the text amendments or the procedures listed above. ORS 197.763 provides that under certain circumstances, the record may remain open or a continuance may be granted upon the request of a participant. If you are unable to attend the hearing, you may submit a written statement to the Planning Department at 150 E Main Street, Hillsboro, Oregon 97123, on or before the hearing date. Pursuant to ORS 197.763, failure to raise an issue at the final evidentiary hearing, or by close of the record, in person or by letter, or failure to provide sufficient specificity to afford the decision maker an opportunity to respond to the issue precludes appeal to the Land Use Board of Appeals based on that issue.
