IN THE CIRCUIT COURT OF THE STATE OF OREGON FOR THE COUNTY OF MULTNOMAH Case No. 19CV18828 SUMMONS OPTION MODEL MANAGEMENT, INC., Plaintiff vs. ALYDA GRACE, Defendant TO: Alyda Grace, the above-named defendant. You are hereby required to appear and defend the complaint filed against you in the above entitled action within thirty (30) days from the date of the first publication of this summons, and in case of your failure to appear and answer, plaintiff for want thereof will apply to the above entitled court for the relief prayed for in its complaint, to-wit: A. FIRST CLAIM FOR RELIEF: 1. For a monetary judgment as follows: a) in an amount to be proven at trial, but not less than $5,200 in commissions that Option would have earned for the work that you failed to perform as described in the complaint; b) in an amount to be proven at trial for the commissions to which Option is entitled under the Agreement for work that you have performed for Royal Models as described in the complaint; and c) in an amount to be proven at trial for future commissions on all work performed by you for Royal Models, and for commissions on all work you would have performed for Option under the Agreement for the term of the Agreement. Option is entitled interest on all of the above at the statutory rate of 9% per annum from the date each commission due to Option under the Agreement was due to be paid to Option until paid in full. B. SECOND CLAIM FOR RELIEF: 1. For a decree of specific performance requiring that you perform your obligations under the Agreement, including but not limited to, abstaining from performing modeling and/or entertainment work for any person or agency other than Option with Option’s written consent C. THIRD CLAIM FOR RELIEF: 1. For a preliminary and permanent injunction prohibiting you from performing any talent engagements which were not secured for you by Option, including, but not limited to, all talent engagements secured for you by Royal Models D. ALL CLAIMS FOR RELIEF: For such other relief as the court may deem appropriate. NOTICE TO DEFENDANT: READ CAREFULLY!! YOU MUST APPEAR IN THIS CASE OR THE OTHER SIDE WILL WIN AUTOMATICALLY.
