PUBLIC NOTICE BALLOT MEASURE May 19, 2020 Primary Election Notice is hereby given that a ballot title for a City of Madras-referred measure for inclusion in the May 19, 2020 primary election has been filed with the City Recorder of the City of Madras on February 13, 2020. The vote will be by mail and will be conducted by the Jefferson County Elections Official in compliance with state election law. The ballot title is as follows: CAPTION: Imposes tax on prepared food to fund road repairs/reconstruction. QUESTION: Shall Madras impose a 5% tax on the purchase of certain prepared food items to fund road repair and reconstruction? SUMMARY: Approval of this measure will impose a 5% tax on the purchase of certain prepared food items ready for immediate consumption (including nonalcoholic beverages) by consumers from restaurants and similar establishments within City of Madras. The tax will be imposed on the consumer and collected at the point of sale and remitted to City by the restaurant operator. Restaurants may keep 5% of the amount collected to offset costs associated with collecting the tax. The tax does not apply to the purchase of groceries or food intended for home consumption. The tax does not apply to, among other things, the purchase of alcoholic beverages, marijuana items, food sold in vending machines, food provided by hospitals, food sold for resale to the public, food sold in bulk and intended for off premises consumption, and confections. Revenue generated by the tax will be used to fund road repair and reconstruction. If passed, the tax will be imposed commencing on April 1, 2021 and will expire on March 31, 2031. ANY ELECTOR WHO IS DISSATISFIED WITH THE BALLOT TITLE MAY PETITION THE CIRCUIT COURT OF JEFFERSON COUNTY TO REVIEW THE BALLOT TITLE NO LATER THAN 5:00 P.M. ON TUESDAY, FEBRUARY 25, 2019.
