COMBINED PUBLIC NOTICE NOTICE OF FINDING OF NO SIGNIFICANT IMPACT ON THE ENVIRONMENT and NOTICE OF REQUEST FOR RELEASE of HOME GRANT FUNDS (Program M-19-UC-41-0201) June 11, 2020 Clackamas County Community Development Division 2051 Kaen Road, Suite 245 Oregon City, Oregon 97045 (503) 655-8591 REQUEST FOR RELEASE OF FUNDS On or about June 26, 2017 the above-named Clackamas County will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of HOME Investment Partnerships Program funds under the National Affordable Housing Act, as amended, and Section 18 PHA Project-Based Vouchers for the Construction of one multi-family housing apartment building: Fuller Station Affordable Housing will include 100-units of multi-family, transit-oriented, mixed-income housing at the Fuller Road Station Park & Ride. The Fuller Road Affordable Housing project will be on 2.15 acres of the currently under-utilized Fuller Road Station Park & Ride, owned by TriMet on the southern half of the property. The site is flat, designed for parking, and has minimal landscaping, at present. The development will be located at 9608 SE Fuller Road in unincorporated Clackamas County, Oregon. FINDING OF NO SIGNIFICANT IMPACT A Phase 1 Environmental Site Assessment and Noise study were conducted on the proposed project site. The stormwater treatment facility will be in compliance with County water treatment requirements. Clackamas County has made a determination based on the Phase 1 Assessment and the , the stormwater treatment plan, that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Community Development offices, 2051 Kaen Road, Suite 245, Oregon City, Oregon and may be examined or copied Monday through Thursday 8:30 A.M. to 5:00 P.M. PUBLIC COMMENTS Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to Clackamas County Community Development Division at the above address All comments received by June 25, 2020 will be considered by Clackamas County prior to authorizing submission of a request for release of funds. Commentors should specify which part of this Notice they are addressing. RELEASE OF FUNDS Clackamas County certifies to HUD that Clackamas County and Mark Sirois, in his capacity as Community Development Manager and Certifying Officer, consent to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows Clackamas County to use Program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of funds and Clackamas County certification received by July 13, 2020 or a period of fifteen days from its receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer or other officer of Clackamas County approved by HUD; (b) Clackamas County has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD/State; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to HUD at the Portland Area Office; Green-Wyatt Federal Building, 1220 SW 3rd Avenue, Suite 400, Portland, Oregon 97204-2825. Potential objectors should contact HUD to verify the actual last day of the objection period.
