AVILA and also all other persons or parties unknown claim any right, title, lien or interest in the property described in the Complaint herein; CATHERINE A. AVILA; FARM CREDIT LEASING SERVICES CORPORATION, a federally chartered instrumentality of the United States; VALLEY AGRONOMICS LLC, a Delaware limited liability company; DOE 3 and DOE 4, being the occupants or parties in possession or claiming any right to the possession of the property described in the Complaint herein, Defendant. TO: Defendants Doe 1 and Doe 2: Pursuant to ORCP 7C(2), YOU ARE REQUIRED TO APPEAR AND DEFEND the Complaint filed against you by plaintiff within 30 days from the date of first publication of this summons. If you fail to appear and defend within the required time, Plaintiff will apply to the court for the relief demanded in the Complaint. As relevant to Defendants Doe 1 and Doe 2, the object of the Complaint and the demand for relief are: The Plaintiff seeks to foreclose its trust deed on the real property described below in the principal amount of $7,732,200.25 plus interest, late charges, costs, advances and attorneys’ fees, and to cause the subject property to be sold by the Sheriff of Jefferson County, Oregon, foreclosing the interest of all defendants in the real property with the proceeds applied to satisfy Plaintiff’s lien. The real property is described as follows: PARCEL 1: Commencing at a point on the South line of Section 28, Township 11 South, Range 13 East of the Willamette Meridian, Jefferson County, Oregon, which is 180.00 feet East of the South Quarter Corner of said Section 28, thence North 01deg.07’30 East parallel with the center line of said Section 28 a distance of 1063.01 feet to the True Point of Beginning; thence continuing North 01deg.07’30 East parallel with said centerline a distance of 720.00 feet to the South right-of-way line of Ninth Street; thence South 88deg.46’51 East along said South right-of-way line a distance of 1722.42 feet to the West right-of-way line of Butte Avenue; thence South 01deg.10’56 West along said West right-of-way line a distance of 720.00 feet to a point from which the True Point of Beginning bears North 88deg.46’51 West; thence North 88deg.46’51 West a distance of 1721.70 feet to the True Point of Beginning. PARCEL 2: Commencing at a point on the South line of Section 28, Township 11 South, Range 13 East of the Willamette Meridian, Jefferson County, Oregon, which is 180.00 feet East of the South Quarter Corner of said Section 28, thence North 01deg.07’30 East parallel with the center line of said Section 28 a distance of 1783.01 feet to the South right-of-way line of Ninth Street; thence South 88deg.46’51 East along said South right-of-way line a distance of 1722.42 feet to the West right-of-way line of Butte Avenue; thence continuing South 88deg.46’51 East along said South right-of-way line a distance of 60.00 feet to the East right-of-way line of Butte Avenue and the True Point of Beginning: thence continuing South 88deg.46’51 East along the South line of said Ninth Street a distance of 599.24 feet to a point 62.00 feet West of the East line of said Section 28; thence South 01deg.14’21 West parallel with said East line a distance of 720.00 feet: thence North 88deg.46’51 West, 598.52 feet to the East right-of-way line of said Butte Avenue; thence North 01deg.10’56 East along said East line a distance of 720.00 feet to the True Point of Beginning.
