TRUSTEE’S NOTICE OF SALE Reference is made to that certain Trust Deed made by FAIRWAY PROPERTIES 1, LLC, an Oregon limited liability company, is the Grantor, and CHICAGO TITLE COMPANY OF OREGON is the Trustee, and ZACHARY, LLC, an Oregon limited liability company, WILLIAM BIGELSON AND PHYLLIS DONNA BIGELSON, TRUSTEES OF THE WILLIAM BIGELSON AND PHYLLIS DONNA BIGELSON REVOCABLE TRUST, and JANINE AND DARREN CASDEN, TRUSTEES OF THE CASDEN FAMILY REVOCABLE TRUST are the Beneficiaries under that certain Trust Deed dated October 30, 2018, and recorded on November 13, 2018, as Document Number 2018-117376, in the Multnomah County Official Records, State of Oregon, covering the following described real property situated in said county and state, to-wit: Parcel 2, PARTITION PLAT NO. 2005-172, in the City of Fairview, County of Multnomah and State of Oregon. TOGETHER WITH a reciprocal access easement as shown on the recorded Plat over that portion of parcel 3, PARTITION PLAT NO. 2005-172, which abuts the West line of said Parcel 2. The street address or other common designation, if any, for the real property described above is purported to be 20922 NE Sandy Blvd. The Property ID and Account Number is R575543. Both the Beneficiaries and the successor trustee, Christopher C. Blattner, have elected to foreclose the above referenced Trust Deed and sell the said real property to satisfy the obligations secured by the Trust Deed and a Notice of Default and Election to Sell has been recorded pursuant to ORS 86.735(3). All right, title, and interest in the said described property which the Grantor had, or had power to convey, at the time of execution of the Trust Deed, together with any interest the Grantor or its successors in interest acquired after execution of the Trust Deed shall be sold at public auction to the highest bidder for cash to satisfy the obligations secured by the Trust Deed and the expenses of sale, including the compensation of the trustee as provided by law, and the reasonable fees of trustee’s attorneys. The default for which foreclosure is made is the Grantor’s failure to pay the loan secured by the Trust Deed by its maturity date, which has been extended from November 12, 2019 to April 30, 2020, to the Beneficiaries, such default beginning November 12, 2019, and continuing through the date of this Notice and any defaults or breaches occurring after the date of this document. The current balance of payments now due, together with late charges, attorney and trustee fees, costs, title expenses, and other allowed charges is approximately $941,763.70 together with any default in the payment of recurring obligations as they become due, periodic adjustments to the payment amount, any further sums advanced by the beneficiaries to protect the property or its interest therein, additional costs and attorney fees as provided by law, and prepayment penalties/premiums, if any, together with defaulted amounts owed to senior lienholders. Notice is further given that any person named in ORS 86.753 has the right, at any time prior to five days before the date last set for sale, to have this foreclosure proceeding dismissed and the Trust Deed reinstated by payment to the Beneficiaries of the entire amount then due (other than such portion of the principal as would not then be due had no default occurred) and by curing any other default complained of herein that is capable of being cured by tendering the performance required under the obligation(s) of the Trust Deed, and in addition to paying said sums or tendering the performance necessary to cure the default, by paying all costs and expenses actually incurred in enforcing the obligation and Trust Deed, together with trustee’s and attorney’s fees not exceeding the amounts provided by ORS 86.753.
