NOTICE OF PUBLIC HEARING BEFORE THE CITY COUNCIL (Legislative – LOC 50.07.003.16.e) Hearing Date, Time, and Location: The Lake Oswego City Council will hold a public hearing on Tuesday, September 1, 2020, at 6:30 p.m. Due to COVID-19 and Executive Orders issued by Governor Brown, city facilities are currently closed to the public. This meeting will be held virtually with opportunities for the public to participate. Instructions on how to participate will be available on the City Council’s meeting webpage no later than six days prior to the hearing: https://www.ci.oswego.or.us/citycouncil/city-council- meeting-369 File Numbers: LU 20-0019 (Ordinance 2851) Applicant: City of Lake Oswego Nature of Application and Proposed Legislative Amendments: An ordinance amending Chapter 50 (Community Development Code) of the Lake Oswego Code for the purpose of allowing seasonal (Nov. 1 – April 30) restaurant enclosures on private property in commercial zones. Proposed amendments are to the following Lake Oswego Code sections: 50.03.003.6 Use Specific Standards for Commercial Uses; 50.03.005.4 Temporary Structures and Uses standards; 50.06.001.5 Commercial Building Design standards; 50.07.003.13 Ministerial Development Decisions; and 50.10.003 Definitions. Depending on location, size and height of the restaurant enclosures, the review process will either be a Ministerial or Minor Development decision (see attached draft code amendments for more details). The Commercial Building Design standards listed in 50.06.001.5 for seasonal enclosures would apply subject to minor development review process (50.07.003.14). The Parking standards listed in LOC 50.06.002 would not apply to seasonal restaurant enclosures. The following Overlays and Design Districts would not apply to seasonal restaurant enclosures: 50.05.004 Downtown Redevelopment Design District; 50.05.005 West Lake Grove Design District; 50.05.007 Lake Grove Village Center Overlay District; and 50.05.008 Southwest Overlay District. On August 10, 2020, the Planning Commission made a final recommendation that the City Council approve the proposed amendments. The title of the ordinance is as follows: Ordinance 2851 An ordinance of the City of Lake Oswego amending Chapter 50 (Community Development Code) of the Lake Oswego Code for the purpose of allowing seasonal (Nov. 1 – April 30) restaurant enclosures on private property in commercial zones; and adopting findings (LU 20-0019).
