IN THE SUPERIOR COURT OF WASHINGTON FOR CLARK COUNTY NO. 20-5-00264-06 SUMMONS & NOTICE OF PETITION/ HEARING RE TERMINATION OF PARENT-CHILD RELATIONSHIP (Clerk’s Action) In re the Interests of: HAYDN DANIEL MARCELLA, D.O.B December 18, 2004 A Minor child To Palaina Brian Gasper and to any person claiming a paternal interest in the above-named child. You have been named as the father of the above-named child. A Petition for Termination of Parent-Child Relationship has been filed in the above-entitled court. The petitioners are asking the court for an order permanently terminating the parent-child relationship between you and the child, permanently terminating all of your rights to the child and for a Decree of Adoption declaring the prospective adoptive parents to be the legal parents of the child. The child, HAYDN DANIEL MARCELLA, was born in Multnomah County, Oregon on December 18, 2004. This child’s mother’s name at the time of child’s birth was Margaret Ashley Marcella. In order to defend against the petition, you must respond to the petition by stating your answer in writing and by serving a copy on the attorney for the petitioners, Kathleen McCann, at the address below prior to the hearing date on December 18, 2020 at 1:30 p.m or an order permanently terminating your parent-child relationship with the child by default will be entered. A default order is one where the petitioners are entitled to what they ask for because you have not responded. If you serve a notice of appearance on the attorney of record at the address below, you are entitled to notice before a default order may be entered. One method of filing your response and serving a copy on the petitioners is to send it by certified mail with return receipt requested. You have the right to be represented by an attorney. If you are indigent and request an attorney, an attorney will be appointed for you. You have the right to file a claim of paternity under Chapter 26.26 of the Revised Code of Washington or to respond to the petition for termination of parent-child relationship which has been filed herein, within thirty days (30) of personal service of the summons and notice upon you and prior to the hearing set below. Your failure to file a claim of paternity under Chapter 26.26 of the Revised Code of Washington or to respond to the petition for termination of parent-child relationship which has been filed herein, prior to the hearing set in this matter, December 18, 2020 is grounds to terminate your parent-child relationship with respect to the child. If the child is an Indian Child as defined by the Indian Child Welfare Act of 1978, 25 U.S.C. 1901 et sec. or eligible for membership in an Indian Tribe and if you acknowledge paternity of the child or if your paternity of the child is established prior to the termination of the parent-child relationship, your parental rights may not be terminated unless you give valid consent to termination or your parent-child relationship or your parent-child relationship is terminated involuntarily pursuant to Chapter 26.33 or 13.34 RCW. HEARING DATE: The court hearing on the Petition for Termination of Parent-Child Relationship shall be on December 18, 2020 at 1:30 p.m. in the Clark County Superior Court, Adoption Department, Family Law Annex: 601 W.
