IN THE CIRCUIT COURT OF THE STATE OF OREGON FOR THE COUNTY OF MULTNOMAH Case No. 20CV43973 ORS 33.710 NOTICE BY PUBLICATION TO: City of Portland, and All Electors, Freeholders, Taxpayers and Other Interested Persons. In the Matter of: Validation Proceeding to Determine the Legality of City of Portland’s expenditure of ratepayer funds to implement the Community Opportunities Enhancement Program, and related implementation actions and decision-making rubric, under the Portland City Charter. Pursuant to ORS 33.710 and 33.720, the above-described validation proceeding was initiated in Multnomah County Circuit Court to determine the legality of the City of Portland’s use of ratepayer funds to implement the City’s Community Opportunities Enhancement Program and related implementation actions and decision-making rubric under Portland City Charter Sections 2-104, 2-105, 9-102, and 11-101, among others. By Resolution No. 37331 on November 8, 2017, Portland City Council directed the City’s Office of Management and Finance and Office of Equity and Human Rights to develop the Community Opportunities and Enhancements Program to advance efforts to strengthen minorities and women in the workforce, as well as disadvantaged, minority-owned, women-owned and emerging small businesses (D/M/W/ESB) contractors and subcontractors, and support the workforce that will be working on current and future City construction projects. In that Resolution, Council directed the COEP to be funded through the collection of 1% of hard construction costs on each City public improvement construction project, including ratepayer-funded Water Bureau and Bureau of Environmental Services construction projects. The Community Opportunities Enhancement Program and its implementing Intergovernmental Agreement between the City and Prosper Portland were adopted by Ordinance No. 189834 on January 29, 2020. On March 11, 2020, Portland City Council passed Resolution No. 37482, directing the Portland City Attorney’s Office to commence a validation proceeding to confirm the legality of the expenditure of ratepayer funds to implement the Community Opportunities Enhancement Program and related implementation actions and decision-making rubrics under the Portland City Charter. The City seeks an expeditious judgment of the Court pursuant to ORS 33.710 and 33.720 declaring that (1) the City of Portland’s expenditure of ratepayer funds to implement the Community Opportunities Enhancement Program is authorized under the Portland City Charter; (2) using the decision-making rubric is a valid method to determine the proper expenditure of ratepayer funds to implement the Community Opportunities Enhancement Program; and (3) the framework set forth in the implementing Intergovernmental Agreement between the City and Prosper Portland for implementing the Community Opportunities Enhancement Program is valid under the Portland City Charter. The City further seeks any other relief that the Court deems just and equitable.
