PUBLIC NOTICE PLANNING COMMISSION PUBLIC HEARING NOTICE IS HEREBY GIVEN: That the City of Fairview Planning Commission will hold a public hearing to review the following land use application at 6:30pm on Tuesday, February 23, 2021. Due to the restrictions in place established by the Governor’s Stay-at-Home Order, Fairview City Hall is closed and the meeting will be held on Zoom using the following link: https://zoom.us/j/94575877891; passcode 1908 Interested persons may appear and testify on the proposal. Those wishing to participate in the meeting are asked to notify the Fairview City Recorder at 503-674-6224 or LeymasterD@ci.fairview.or.us at least 24 hours prior to the start of the meeting so arrangements may be coordinated. Case File No. 2020-34-CUP pertaining to construction of a new 650 foot well on portions of a tax lot in Fairview’s Village Single Family zone (tax map 1N3E33AA-00100/ Tax Lot R161165). The applicant is requesting Conditional Use approval to construct a new well on a 1-acre portion of City-owned property at 1260 NE Multnomah Drive. New site improvements will include a well house and pumps, a paved pull-through access on NE 223rd Avenue, two driveway connections, fencing, and native plantings. Onsite water lines will be stubbed for a water treatment building to be permitted separately in the future. The applicant is also requesting a variance to Multnomah County Road Rules standards to allow access from NE 223rd, a County road. Multnomah County Transportation is reviewing this request in parallel with the land use review. The application will be reviewed for consistency with the following sections of the Fairview Municipal Code: — FMC 19.115 Village Single-Family (VSF) — FMC 19.30 Residential (R) District — FMC 19.108 Community Service/Parks Overlay (R/CSP) — FMC 19.140 Village General Standards- Landscaping Standards — FMC 19.162 Access and Circulation — FMC 19.165 Public Facilities Standards — FMC 19.400 Administration of Land Use & Development Review — FMC 19.413 Procedures — FMC 19.440 Conditional Use Permits The Road Rules Variance application will be reviewed for consistency with the following sections of the Multnomah County Road Rules: — 4.000 Access to County Roads — 16.000 Variance from County Standards and Requirements The application is subject to the Type III review process in accordance with Fairview Municipal Code 19.413, which follows a quasi-judicial process. A decision on the above application may be made at the public hearing on February 23rd, 2021. When rendered, the decision will be mailed to the applicant and to anyone else who submitted written comments or who is otherwise legally entitled to notice. If you wish to appeal the request on a particular issue, that issue must be raised in writing prior to the hearing, or verbally within the public hearing. Issues must be raised with sufficient specificity to enable the decision-maker to respond to the issues. All evidence relied upon by the Planning Commission to make this decision is in the public record, available for public review. A copy of the staff report will be available seven days before the hearing. Copies of this evidence and the staff report can be obtained at a reasonable cost from the City.
