SUMMONS BY PUBLICATION NOTICE TO: THEA GIRARD MARSHALL, 29030 SW Town Center Loop East, Suite 202-152, Wilsonville, OR 97070. You have been named a defendant in the complaint in the following case: IN THE CIRCUIT COURT OF COOK COUNTY, ILLINOIS, No. 2020 CH 06195. BMO HARRIS BANK, N.A., as Trustee, Plaintiff, v. THEA GIRARD MARSHALL, Defendant. You are summoned and required to file your appearance, in the office of the clerk of the court, within 60 days after service of this summons, not counting the day of service. If you fail to do so, a judgment by default may be entered against you for the relief asked in the complaint, to wit: (a) Approving the accounts of BMO Harris Bank N.A., as Trustee of the Thea Girard Marshall Trust dated August 18, 1995, as amended and restated October 30, 1995; (b) Confirming that Ms. Marshall is the only necessary party due to the revocable nature of the Trust and Arizona Statute 14-10603; (c) Approving the termination of the Thea Girard Marshall Trust dated August 18, 1995, as amended and restated October 30, 1995 pursuant to Section 3.08 of Article III of the Thea Girard Marshall Trust dated August 18, 1995, as amended and restated October 30, 1995, and distribution of the assets outright to Ms. Marshall addressed to her most recent mailing address, upon payment of the final and usual customary administrative fees from the Trust including attorneys’ fees and other costs of this litigation as the court shall deem reasonable and proper; or in the alternative, permitting BMO Harris to resign as Trustee and appointing Ms. Marshall as Trustee of her Trust, upon payment of the final and usual customary administrative fees from the Trust including attorneys’ fees and other costs of this litigation as the court shall deem reasonable and proper; (d) Releasing and discharging BMO Harris Bank N.A. with respect to its actions as Trustee and with respect to the actions contemplated by this Petition; (e) Directing BMO Harris Bank N.A., as Trustee of the Thea Girard Marshall Trust dated August 18, 1995, as amended and restated October 30, 1995, to pay from such Trust attorneys’ fees and other costs of this litigation as the court shall deem reasonable and proper; and (f) Granting BMO Harris Bank N.A., as Trustee of the Thea Girard Marshall Trust dated August 18, 1995, as amended and restated October 30, 1995, such other or further relief as shall be proper.
