Notice of Preliminary Determination for Water Right Transfer T-13190 T-13190 filed by Fessler Family, LLC, 13009 McKee School Road, Woodburn, OR 97071, proposes an additional point of diversion and a change in place of use under Certificate 29565, and a change in place of use under Certificate 90327. Certificate 29565 allows the use of 0.20 cubic foot per second (cfs) from Zollner Creek in Sec. 33, T5S, R1W, WM for irrigation in Sec. 33, T5S, R1W, WM. The applicant proposes an additional point of diversion in Sec. 28, T5S, R1W, WM and to change the place of use to Sects. 28 and 33, T5S, R1W, WM. Certificate 90327 allows the use of 0.372 cfs from a well in Sec. 33, T5S, R1W, WM for irrigation and supplemental irrigation in Sec. 33, T5S, R1W, WM. The applicant proposes to change the place of use to Sects. 28 and 33, T5S, R1W, WM. The Water Resources Department proposes to approve the transfer, based on the requirements of ORS Chapter 540 and OAR 690-380-5000. Any person may file, jointly or severally, a protest or standing statement within 30 days after the last date of newspaper publication of this notice, February 24, 2021.
