WILLIAMS, or her successor interest, as TRUSTEE OF THE CAROL J. WILLIAMS REVOCABLE TRUST dated October 17, 2001 by assignment recorded on March 28, 2011 under Instrument No. 201104177 of the Official Records of Yamhill County, State of Oregon; and the beneficial interest of ARTHUR FRANCIS STODDARD STEELE AND LYNNE MARIE STEELE was assigned to STEPHEN D. SNODGRASS by assignment recorded on April 4, 2012 as Instrument No. 201204339 of the Official Records of Yamhill County, State of Oregon; and the beneficial interest of MARCI OLSEN-FURNISH who acquired title as MARCI OLSEN, GAIL DONABEDIAN and DENIS M. CENTOFANTE was assigned to STEPHEN D. SNODGRASS by assignment recorded on November 1, 2012 as Instrument No. 201215807 of the Official Records of Yamhill County, State of Oregon, and re-recorded on November 5, 2012 as Instrument No. 201215995 of the Official Records of Yamhill County, State of Oregon; and the beneficial interest of GLEN D. GANZER was assigned to STEPHEN D. SNODGRASS by assignment recorded on November 28, 2012 as Instrument No. 201217182 of the Official Records of Yamhill County, State of Oregon, and re-recorded on December 3, 2012 as Instrument No. 201217489 of the Official Records of Yamhill County, State of Oregon, (Trust Deed) encumbering the following described real property situated in the above mentioned County and State: Described in the attached EXHIBIT A Real Property Tax ID No.: 1722 (R2316 04100); 538987 (R2316 04105); 538990 (R2316 04106); 538993 (R2316 04107); 538996 (R2316 04108); 539008 (R2316 04112); 539005 (R2316 04111); 539002 (R2316 04110); 538999 (R2316 04109); 539011 (R2316 04113); 1731 (R2316 04200). There is default by the Grantor or other person owing an obligation, the performance of which is secured by the Trust Deed, with respect to any provision in the Trust Deed, which authorizes sale in the event of default of such provision; the defaults are: The obligation, the performance of which is secured by the Trust Deed, matured on March 1, 2020, and the amounts due include unpaid principal in the amount of $699,000.00, together with accrued interest from March 1, 2009 through February 3, 2021, in the total amount of $1,762,121.55, with interest accruing thereafter until paid; nine unpaid interest-only payments of $7,426.88 each, in the total amount of $66,841.92; late charges for interest-only payments of ten percent (10%) of the interest-only payments due, in the total amount of $6,684.19; delinquent property taxes paid on August 15, 2020 in the amount of $5,783.65, with accrued interest from August 15, 2020 to February 3, 2021, in the total amount of $6,131.14, with interest accruing thereafter until paid; delinquent property taxes paid on January 29, 2021 in the amount of $9,446.63, with accrued interest from January 29, 2021 to February 3, 2021, in the total amount of $9,463.13, with interest accruing thereafter until paid; attorney’s fees, trustee’s fees, together with any other sums due or that may become due under the Note or by reason of this foreclosure and any further advances made by the Beneficiary as allowed by the Note and Trust Deed. Based upon the defaults, the beneficiary has declared all sums owing on the obligation secured by the Trust Deed, as modified, immediately due and payable, those sums being the following: Principal balance in the amount of $699,000, together with accrued interest from March 1, 2009 through February 3, 2021, in the total amount of $1,762,121.55, with interest accruing thereafter until paid; nine unpaid interest-only payments of $7,426.88 each, in the total amount of $66,841.92; late charges for interest-only payments of ten percent (10%) of the interest-only payments due, in the total amount of $6,684.19; delinquent property taxes paid on August 15, 2020 in the amount of $5,783.65, with accrued interest from August 15, 2020 to February 3, 2021, in the total amount of $6,131.14, with interest accruing thereafter until paid; delinquent property taxes paid on January 29, 2021 in the amount of $9,446.63, with accrued interest from January 29, 2021 to February 3, 2021, in the total amount of $9,463.13, with interest accruing thereafter until paid; attorney’s fees, trustee’s fees, together with any other sums due or that may become due under the Note or by reason of this foreclosure and any further advances made by the Beneficiary as allowed by the Note and Trust Deed. The Beneficiary and Successor Trustee, by reason of the default, have elected to foreclose the Trust Deed by advertisement and sale, and to cause to be sold at public auction to the highest bidder for cash the interest in the Property which the Grantor has to satisfy the obligations secured by the Trust Deed and the expenses of the sale, including the compensation of the trustee and the trustee’s attorneys. A Notice of Default and Election to Sell has been recorded pursuant to Oregon Revised Statutes 86.752(3). WHEREFORE, the undersigned Successor Trustee will at 1:00 P.M., based upon the standard of time established by ORS 187.110 on Thursday, June 17th, 2021, at the following place: Entrance to the Yamhill County Circuit Court Courthouse located at 535 NE 5th St., McMinnville, OR 97128, sell at public auction to the highest bidder for cash the interest in the Property which the Grantor has to satisfy the obligations secured by the Trust Deed and the expenses of sale, including the compensation of the Successor Trustee and the Successor Trustee’s attorneys. The Grantor, the Grantor’s successor in interest to all or any part of the Property, any beneficiary under a subordinate trust deed, or any person having a subordinate lien or encumbrance of record on the Property, have the right under ORS 86.778 to have this foreclosure proceeding dismissed and the Trust Deed reinstated by paying the entire amount then due, other than that portion that would not then be due had no default occurred, together with all costs, trustee’s fees and attorney fees, and by curing any other default complained of in this notice of default, at any time that is not later than five days before the date last set for the sale. Without limiting the trustee’s disclaimer of representations or warranties, Oregon law requires the trustee to state in this notice that some residential property sold at a trustee’s sale may have been used in manufacturing methamphetamines, the chemical components of which are known to be toxic. Prospective purchasers of residential property should be aware of this potential danger before deciding to place a bid for this property at the trustee’s sale.
