Crabtree, Trustee of the Virginia Carleen DeLaVaux Revocable Trust, now or formerly of Alta Loma in the state of California, or their heirs, devisees, legal representatives, successors or assigns and to all other persons interested. A petition has been presented to said Court by Stanley F. Sekunda, Jr., Trustee of Stanley F, Sekunda Trust-1990 and Stanley F. Sekunda, Jr., Individually, of Middletown in the state of Rhode lsland, representing that he as Trustee of Stanley F. Sekunda Trnst-1990 holds, as tenant in common, an undivided 69.99% interest and holds, individually, as tenant in common, an undivided 7.90% interest of certain land lying in the Town of Westport, in the County of Bristol, and briefly described as follows: That parcel of land, with all buildings and improvements thereon, situated in said Westport, Bristol County, Massachusetts, bounded and described as follows: Beginning at the west side of the road leading from the Head of Westport River to Hick’s Bridge; on the east by the road aforesaid; on the north by land now or formerly of Michael Sullivan, Zebidias D. Kirby and James E. Tripp on the west by land now or formerly of Abraham Kirby; and on the south by land now or formerly of Jonathan P. Tripp and a Mrs. Atwood, together with the laneway to the west road. Containing 50 acres more or less. Subject to a taking by the Town of Westport for highway purposes, Layout No. 4927, Parcel No. 3-21, as shown on layout dated December 29, 1959, as recorded in the Bristol County South District Registry of Deeds. The above description depicts SO acres comprised of two parcels of land. Petitioner is seeking to sell 25 acres at private sale and exclude 10 acres contained in parcel on the westerly side of Route 88. Setting faith that he desires that all the described land may be sold at private sale for not less than $500,000 dollars ( 25 acres only) and praying that partition may be made of all the land aforesaid according to law, and to that end that a commissioner be appointed to make such partition and be ordered to make sale and conveyance of all, or any part of said land which the Court finds cannot be advantageously divided, either at private sale or public auction, and be ordered to distribute the net proceeds thereof. If you desire to object thereto, you or your attorney should file a written appearance in said Court at Boston, before ten o’clock in the forenoon on the second day of August, 2021, the return day of this citation.
