Herzberg and Doris Herzberg, Husband and Wife as Estate in Fee Simple as Grantor to Land America Lawyers Title as Trustee, in favor of Financial Freedom Senior Funding Corporation, a Subsidiary of IndyMac Bank, F.S.B., Beneficiary of the security instrument, its successors and assigns, dated as of 7/29/2004 and recorded on 8/3/2004 as Instrument No. 2004-003468, and the beneficial interest was assigned to HMC Assets, LLC solely in its capacity as Separate Trustee of CAM XI Trust and recorded 9/14/2020 as Instrument Number 2020-03738 of official records in the Office of the Recorder of Jefferson County, Oregon to-wit: APN: 9712 Map No. 11311-DA-10500 THE LAND REFERRED TO HEREIN BELOW IS SITUATED IN THE COUNTY OF JEFFERSON, STATE OF OREGON, AND IS DESCRIBED AS FOLLOWS: Lots 23 and 24, Block 17, Depot Addition to Madras, Jefferson County, Oregon, as recorded in Plat Book 1, Page 16, Jefferson County Records. Commonly known as: 123 SW I Street, Madras, OR 97741 Both the Beneficiary, HMC Assets, LLC solely in its capacity as Separate Trustee of CAM XI Trust, and the Trustee, Synova M.L. Edwards, Esq, have elected to sell the said real property to satisfy the obligations secured by said Trust Deed and notice has been recorded pursuant to Section 86.752(3) of Oregon Revised Statutes. The default for which the foreclosure is made is the Grantor’s failure to pay: The unpaid principal balance of $114,834.94 plus accrued interest of $62,563.84 good to 7/9/2021, plus any advances made by the beneficiary which became all due and payable pursuant to Paragraph 9(a)(i)in the deed of trust on 02/09/2019 (date of death). As a result, you are also in default for Attorneys’ fees and other expenses and costs of collection; and other amounts collectable under the Note and Deed of Trust; and trustees and foreclosure fees and expenses. By this reason of said default the Beneficiary has declared all obligations secured by said Trust Deed immediately due and payable, said sums being the following, to-wit: The sum of $114,834.94 and accruing interest as of 7/9/2021 totaling $62,563.84 until paid; plus all accrued late charges thereon; and all Trustee’s fees, foreclosure costs and any sums advanced by the Beneficiary to the terms of said d Trust Deed for a total sum due of $199,966.49 as of 7/9/2021. Wherefore, notice is hereby given that, the undersigned Trustee will on 11/19/2021 at the hour of 1:00 PM, Standard of Time, as established by Section 187.110, Oregon Revised Statues, at Inside the main entrance of the Jefferson County Courthouse, 129 SW E Street, Madras, OR 97741 County of Jefferson, sell at public auction to the highest bidder for cash the interest in the said described real property which the Grantor had or had power to convey at the time of the execution by him of the said Trust Deed, together with any interest which the Grantor or his successors in interest acquired after the execution of said Trust Deed, to satisfy the foregoing obligations thereby secured and the costs and expenses of sale, including a reasonable charge by the Trustee. Notice is further given that any person named in Section 86.778 of Oregon Revised Statutes has the right to have the foreclosure proceeding dismissed and the Trust Deed reinstated by payment to the Beneficiary of the entire amount then due (other than such portion of said principal as would not then be due had no default occurred), together with the costs, Trustee’s or attorney’s fees and curing any other default complained of in the Notice of Default by tendering the performance required under the obligation or Trust Deed, at any time prior to five days before the date last set for sale.
