To: ALL OTHER PERSONS OR PARTIES UNKNOWN CLAIMING ANY RIGHT, TITLE, LIEN, OR INTEREST IN THE PROPERTY DESCRIBED IN THE COMPLAINT HEREIN located at 27434 S. Highway 213, Mulino, Oregon 97042, You are hereby required to appear and defend the Complaint filed against you in the above-entitled cause within thirty (30) days from the date of service of this summons upon you, and in case of your failure to do so, for want thereof, Plaintiff will apply to the court for the relief demanded in the Complaint, to-wit: For relief against Defendants as follows: 1. Judgment in favor of Plaintiff and against Defendants on each of Plaintiff’s claims for relief (Quiet Title, Injunctive and Declaratory Relief, Nuisance, Trespass, Negligence); 2. Requiring Defendants, and all persons claiming under or through Defendants, to set forth the nature of their claims, if any, to the real property located at 27434 S. Highway 213, Mulino, Oregon 97042 (the Property) 3. Determining all adverse claims, if any, of Defendants, and all persons claiming under Defendants; 4. For an order declaring Plaintiff to be the owner in fee simple of the Property and entitled to possession thereof, free of any estate, title, claim, lien, or interest of Defendants or those claiming under Defendants, and quieting title in the Property in Plaintiff; 5. For an order and injunction permitting Plaintiff to repair and restore the fence damaged by Defendants and requiring Defendants to cease entering the Property; 6. Awarding Plaintiff a judgment and money award under Plaintiff’s claims for nuisance, trespass, and negligence against Defendants Jack Davis and Ya is the creator LLC, in an amount to be determined, but not less than $10,000.00 with pre- and post-judgment interest at the statutory rate of 9% per annum until paid; 7. For judgment and money award against Defendants for Plaintiff’s attorney fees, costs, and disbursements; and 8. For such other relief the Court deems just and equitable.
