NOTICE OF PUBLIC HEARING FOREST GROVE PLANNING COMMISSION UNLISTED USE AUTHORIZATION FILE NUMBER 311-21-000050-PLNG NOTICE IS HEREBY GIVEN that the Forest Grove Planning Commission will hold a Public Hearing on Tuesday, January 18, 2022, at 7:00 p.m. or thereafter, at the Community Auditorium, 1915 Main Street and via Zoom video conferencing to review the following proposal: — Unlisted use authorization to allow a landscaping maintenance business in the Community Commercial zone at 1920 23rd Avenue (Washington County Tax Lot 1N331CC05601). The Planning Commission will consider the similar use authorization request and base their decision on the following review criteria. Comments in response to this proposal must address the criteria: — Forest Grove Development Code: 17.12.160(C) and (D), Unlisted Use: Authorization of Similar Use: Approval standards. Approval or denial of an unlisted use application shall be based on findings that: 1. The use is consistent with the intent and purpose of the applicable zoning district. 2. The use is similar to and of the same general type as the uses listed in the zoning district. 3. The use has similar intensity, density and off-site impacts as the uses listed in the zoning district, and 4. The use has similar impacts on community facilities as the listed uses. Community facilities in include streets, schools, libraries, parks, police and fire stations, and water, sanitary sewer, and storm drainage systems. Other provisions. 1. The Director shall not authorize an unlisted use in a zoning district if the use is specifically listed in another zone as either a permitted use or a conditional use. All persons will be given reasonable opportunity to give testimony about this proposal responding to the review criteria above. If an issue is not raised in the hearing (by person or by letter) or if the issue is not explained in sufficient detail to allow the Planning Commission to respond to the issue, then that issue cannot be used for an appeal to the Land Use Board of Appeals. If additional documents or evidence are provided in support of the application, any party shall be entitled to a continuance of the hearing. Unless there is a continuance, if a participant so requests before the conclusion of the initial evidentiary hearing, the record shall remain open for at least seven days after the hearing.
