NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS CENTURY COMMONS PROJECT January 11, 2022 City of Hillsboro 150 E Main St. Hillsboro, OR 97123 (503) 681-6200 These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Hillsboro. REQUEST FOR RELEASE OF FUNDS On or about February 4, 2022, the City of Hillsboro will submit a request to U.S. Department of Housing and Urban Development (HUD) for the release of SHOP funds under Self-Help Homeownership Opportunity Program (SHOP) authorized by Section 11of the Housing Opportunity Program Extension Act of 1996 (42 U.S.C. 12805 note). To undertake the following project: Habitat for Humanity Portland/Metro East (Habitat) will build 18 attached homes on the project site. Future activities will include: clearing and excavation of the site; installation of utilities, including water, sewer, stormwater, and electrical; pouring foundations and building energy-efficient one, two, and three-story wood-frame structures; and standard site work such as drainage facilities, parking, and landscaping. All activities will comply with City of Hillsboro building and zoning codes and regulations. Habitat anticipates that work on the site will commence in 2022. The project should be completed in 2023. The homes will be sold to homebuyers whose incomes are 35%-80% MFI. FINDING OF NO SIGNIFICANT IMPACT The City of Hillsboro has determined that the project will have no significant impact on the human environment. Therefore; an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at 150 E. Main Street, Hillsboro, OR 97123 and may be examined or copied weekdays from 8AM to 5PM. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the City of Hillsboro Community Development Department by contacting Omar Martinez at Omar.Martinez@Hillsboro-Oregon.gov. All comments received by February 4, 2022, will be considered by the City of Hillsboro prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing. ENVIRONTMENTAL CERTIFICATION The City of Hillsboro certifies to HUD that Robby Hammond in his capacity as City Manager consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the City of Hillsboro to use Program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of funds and the City of Hillsboro’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Hillsboro; (b) the City of Hillsboro has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the development process have committed fund, incurred cost, or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD at 1220 SW 3rd Ave., Suite 400, Portland, OR 97204.
