TRUSTEE’S NOTICE OF SALE Reference is made herein to that certain trust deed (the Trust Deed) made on June 5, 2019 by Anna White (Grantor), to Tyler Smith, attorney at law for Tyler Smith & Associates P.C. (Trustee), for the benefit of PaulMichael Moore (Beneficiary), dated June 5, 2019, and recorded June 6, 2019, as instrument no. 2019-056712, in the records of Multnomah County, Oregon. The Trust Deed covers the following described real property situated in Multnomah County, Oregon: See Exhibit A attached hereto and made a part hereof, and commonly known as: 8419 SE Barbara Welch Road Portland, Oregon 97236 The Beneficiary has elected to sell the above-described real property to satisfy the obligations secured by the Trust Deed and notice of default has been recorded pursuant to ORS 86.752(3). The default for which the foreclosure is made is the Grantor’s failure to pay when due the $1,000.00 monthly installments of principal following written notice and demand therefor on November 1, 2019, and on June 8, 2021, pursuant to Article IV, Section 4.1 of the Trust Deed. As of the date of this notice, Grantor has made no payments under the Note. By reason of the defaults just described, the Beneficiary has declared all sums owing on the obligation secured by the Trust Deed immediately due and payable, those sums as of January 15, 2022, being the following: (a) the principal balance on the Note of $250,000.00 and interest thereon of $41,801.77 at the default rate of 6% from February 1, 2020 to January 15, 2022; (b) unpaid taxes (including interest and penalties, if any) for years 2019 to 2021 of $10,721.54; and attorney fees and costs currently of $2,390.20 and continuing. THE TOTAL PAYOFF AMOUNT IS: $304,913.51, plus interest at 6% per annum compounded monthly after June 15, 2019, plus such additional amounts accruing thereafter until the sale takes place, and title expenses, trustee’s fees, recording fees, and additional attorney fees incurred herein by reason of said default and any further sums advanced by the Beneficiary for the protection of the real property described above and his interest therein. WHEREFORE, NOTICE IS HEREBY GIVEN that the undersigned Trustee will on June 13, 2022, at the hour of 9:30 a.m., in accord with the standard of time established by ORS 187.110, at Multnomah County Courthouse, 1021 SW 4th Ave., Portland, Oregon 97204, on the front steps, sell at public auction to the highest bidder for cash the interest in the real property described above which the Grantor had power to convey at the time of execution by the Grantor of the Trust Deed together with any interest which the Grantor or Grantor’s successors in interest acquired after the execution of the trust deed and the trust deed amendment, to satisfy the foregoing obligations thereby secured and the costs and expenses of the sale, including a reasonable charge by the Trustee. NOTICE IS FURTHER GIVEN that any person named in ORS 86.778 has the right, at any time prior to five (5) days before the date last set for the sale, to have this foreclosure proceeding dismissed and the Trust Deed reinstated by payment to the Beneficiary of the entire amount then due (other than such portion of the principal as would not be then due had no default occurred) and by curing any other default complained of herein that is capable of being cured by tendering the performance required under the obligation, Trust Deed and in addition to paying those sums or tendering the performance necessary to cure the default, by paying all costs and expenses actually incurred in enforcing the obligation, Trust Deed, together with trustee and attorney fees not exceeding the amounts provided by ORS 86.778. Without limiting the Trustee’s disclaimer of representations or warranties, Oregon law requires the Trustee to state in this notice that some residential property sold at a trustee’s sale may have been used in manufacturing methamphetamines, the chemical components of which are known to be toxic. Prospective purchasers of residential property should be aware of this potential danger before deciding to place a bid for this property at the trustee’s sale. In construing this notice, the singular includes the plural, the word grantor includes any successor in interest to the grantor as well as any other person owing an obligation, the performance of which is secured by the Trust Deed, and the words trustee and beneficiary include their respective successors in interest, if any.
