IN THE CIRCUIT COURT OF THE STATE OF OREGON FOR THE COUNTY OF MULTNOMAH CASE NO. 21CV38502 PUBLISHED SUMMONS JEFFREY D. SARAULT, Plaintiff v. MATTHEW DEANE JOHANSEN, Defendant TO: MATTHEW DEANE JOHANSEN, the above-named defendant. You are hereby required to appear and defend the complaint filed against you in the above-entitled action, within thirty (30) days from the date of the first publication of this summons, and in case of your failure to appear and answer, plaintiff for want thereof will apply to the above-entitled court for the relief prayed for in its complaint. SUMMARY STATEMENT: This action relates to payments made by Plaintiff to satisfy a judgment in favor of Wesley Clark, and against Plaintiff Sarault and Defendant Johansen, for claims arising from a partnership between Clark, Sarault and Johansen, doing business as Portland Rosing Company. Defendant Johansen has failed to make his share of the payments on said judgement. WHEREFORE, Plaintiff Sarault prays for the following relief: 1. On his First and Second Claims for Relief (Contribution and Unjust Enrichment), for an award of money damages in the amount of $70,454.27, together with interest at the rate of 9% per annum from the date of each garnishment from Plaintiff’s account, until paid; 2. On his Third Claim for Relief (Declaratory Judgment), for an Order declaring that Plaintiff Sarault’s proportion share of the judgment awarded to Clark was no more than $7,828.25; 3. For an award of his costs and disbursements; 4. For any and all further relief the Court may deem just and proper. NOTICE TO DEFENDANTS: READ CAREFULLY!!
