TRUSTEE’S AMENDED NOTICE OF SALE Eric R. Schimmel and Lori Schimmel, as Grantors, made, executed, and delivered to, Ticor Title Insurance, as Trustee (Sherman, Sherman, Johnnie and Hoyt, LLP is now the duly appointed Successor Trustee), in favor of Wauna Federal Credit Union, now known as Wauna Credit Union, as Beneficiary, that certain trust deed dated July 6, 2006 and recorded on July 11, 2006, in Instrument No. 2006-009094, of the Records of Columbia County, Oregon (the Trust Deed), covering the following described real property commonly known as 74576 Doan Road, Rainier, OR 97048 and situated in said County and State: PARCEL 1 OF PARTITION PLAT NO. 2000-28, RECORDED JUNE 30, 2000. FEE NO. 00-06443, IN COLUMBIA COUNTY OREGON. The Beneficiary and the Trustee have elected to sell the real property to satisfy the obligations secured by the Trust Deed and a notice of default has been recorded pursuant to ORS 86.752(3); the default for which the foreclosure is made is failure to pay when due the monthly installments according to the terms of promissory note, secured by the Trust Deed described above, namely: $1,607.87 Monthly payments in the amount of $376.36 each (due for Aug., Sep., Oct., Nov., and Dec., 2021); $60.00 Late fees; $256.00 Foreclosure Guarantee; $1,923.87 Total amount past due as of January 28, 2022. By power given the Beneficiary under the Trust Deed, Beneficiary herewith declares all sums due under the Trust Deed to be immediately due, owing, and payable without further demand. The true amount due and owing the Beneficiary by the Grantor herein, is as follows: $37,635.66 (principal); $581.72 (interest to January 19, 2022); $60.00 (Late fees); $256.00 (foreclosure Guarantee); $38,533.38 Total due and owing as of January 28, 2022, interest accrues thereafter at the rate of 7.5% per annum ($7.733 diem) on the principal amount, until paid in full. Notice is hereby given that the undersigned will Tuesday, August 2, 2022, at 11:00 o’clock a.m., Pacific Time, on the front steps of the Columbia County Courthouse, 230 Strand St, St Helens, Oregon, sell at public auction to the highest bidder for cash the interest in the said described real property which the Grantors had or had power to convey at the time of the execution by them of the Trust Deed, to satisfy the foregoing obligations thereby secured and the costs and expenses of sale, including a reasonable charge by the trustee. Notice is further given that any person named in ORS 86.778 has the right to have the foreclosure proceeding dismissed and the Trust Deed reinstated by payment of the entire amount due (other than such portion of said principal as would not then be due had not default occurred), together with costs, trustee’s and attorney’s fees as provided by ORS 86.778, and by curing any other default complained of herein that is capable of being cured by tendering the performance required under the obligation of the Trust Deed at any time prior that is not later than five (5) days before the date set for said sale. Without limiting the trustee’s disclaimer of representations or warranties, Oregon law requires the trustee to state in this notice that some residential property sold at a trustee’s sale may have been used in manufacturing methamphetamines, the chemical components of which are known to be toxic. Prospective purchasers of residential property should be aware of this potential danger before deciding to place a bid for this property at the trustee’s sale.
